    BR 017636—Treasurer of Cuyahoga County, Ohio vs. Unknown Heirs, etc., of Matthew H. Fuchs, etc., et al.

    The unknown heirs, devisees, legatees, assignees, executors, administrators and legal representatives of Matthew H. Fuchs, a.k.a. Matthew Fuchs, a.k.a. Matt Fuchs, the place of residence of each being unknown; the unknown heirs, devisees, legatees, assignees, executors, administrators and legal representatives of Frances Eleanor Fuchs, a.k.a. Frances E. Fuchs, a.k.a. Franziska Fuchs, a.k.a. Frances Fuchs, the place of residence of each being unknown; and Andy's Empire Construction and Demolition, whose last known address is c/o Andrew B. Kiss, Statutory Agent, 4321 Pearl Road, Cleveland, OH 44109, otherwise whose address is unknown, will take notice that on September 7, 2018, the undersigned, Treasurer of Cuyahoga County, Ohio, filed his complaint in the Board of Revision, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that by reason of default of the defendants in the payment of taxes, assessments, penalties and the interest upon real estate as delinquent the sum of $615.87 is due and unpaid and a first and prior lien against the following described real estate to wit:

    Permanent Parcel No. 011-01-001

    Situated in the City of Cleveland, County of Cuyahoga and State of Ohio; and known as being the Northwesterly part of Sublots No. 1 in the Leopold Subdivision of part of Original Brooklyn Township Lot No. 58 as shown by the recorded plat in Vol. No. 43 of Maps, Page 2 of Cuyahoga County Records bounded and described as follows: Beginning on the Southeasterly line of West 25th Street (formerly Pearl Road) at the Northwesterly corner of said Sublot No. 1, thence Southwesterly along said Southeasterly line of West 25th Street about 50 feet to the Northwesterly corner of land conveyed to Elizabeth Huy by deed dated August 5, 1920 and recorded in Vol. 2738 and Page 249 of Cuyahoga County Records; thence Easterly along the Northerly line of land so conveyed to Elizabeth Huy about 140.26 feet to the Westerly line of land conveyed to the Brooklyn Catholic Club by deed dated June 16, 1916 and recorded in Vol. 1819 Page 403 of Cuyahoga County Records; thence Northerly along said Westerly line of land so conveyed to the Brooklyn Catholic Club about 44.10 feet to the Northerly line of said Sublot No. 1; thence Westerly along said Northerly line of said Sublot No. 1 about 112.40 feet to the place of beginning as appears by said plat, be the same more or less, but subject to all legal highways.

    That this action in foreclosure proceedings is convened under provisions of Section 323.25 and/or Section 5721.18(a) and/or 323.65 - 323.79 of the Ohio Revised Code.

    Plaintiff prays that the defendants named above be required to appear on the date specified herein and set up their interest in said premises or be forever barred from asserting the same; that all taxes, assessments, penalties and interest due and unpaid, together with the costs of certificate of title, be found to be a good and valid first lien on said premises; that the Board of Revision make such order for payment of costs incurred herein together with $425.00 for the Preliminary Judicial Report; that the Board of Revision order said property to be sold according to law, or conveyed to an eligible township, municipality, county, or community development group pursuant to ORC 323.65 through 323.78 and that an Order of Sale or Order of Conveyance be issued to the Sheriff directing him to either advertise and sell the property at public sale in the manner provided by law; or, to convey the property to an eligible township, municipality, county, or community development group pursuant to ORC 323.65 through 323.78; that thereafter a report of such sale or conveyance be made by the Sheriff to the Board of Revision for further proceedings, if any, under law, and for such other relief as in law or equity this Plaintiff may be entitled.

    The defendants named above have the right to respond as set-forth by O.R.C 323.69(D)(1)(b).
