    BR 019642—Treasurer of Cuyahoga County, Ohio vs. Unknown Heirs, etc. of Joseph A. Pawlak, et al.

    The unknown heirs, devisees, legatees, assignees, executors, administrators and legal representatives of Joseph A. Pawlak, the place of residence of each being unknown; and the unknown heirs, devisees, legatees, assignees, executors, administrators and legal representatives of Marie C. Pawlak, the place of residence of each being unknown, will take notice that on May 7, 2019, the undersigned, Treasurer of Cuyahoga County, Ohio, filed his complaint in the Board of Revision, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that by reason of default of the defendants in the payment of taxes, assessments, penalties and the interest upon real estate as delinquent the sum of $1,342.43 is due and unpaid and a first and prior lien against the following described real estate to wit:

    Permanent Parcel No. 792-06-003

    Situated in the City of Bedford Heights, County of Cuyahoga and State of Ohio: And being part of Original Bedford Township Lot No. 40, and bounded and described as follows: Beginning in the center line of Columbus Road, 60 feet wide, at its intersection with the Westerly line of Original Lot No. 40; thence Southerly along the Westerly line of Original Lot No. 40, 2160.09 feet to the principal place of beginning; thence East and parallel with the center line of Columbus Road 634.03 feet to a point on the Westerly line of Sunset Drive; thence Southerly along the Westerly line of Sunset Drive, to the Northeasterly corner of land conveyed to Albert and Eva Tiffe by deed dated December 16, 1957 and recorded in Volume 9041, Page 61 of Cuyahoga County Records; thence Westerly along the Northerly line of land so conveyed to Albert and Eva Tiffe, to the Westerly line of said Original Lot No. 40; thence Northerly along the Westerly line of said Original Lot No. 40, 160 feet to the principal place of beginning, be the same more or less, but subject to all legal highways.

    Excepting therefrom the following described parcel:

    Situated in the City of Bedford Heights, County of Cuyahoga and State of Ohio: And known as being a part of Original Bedford Township Lot No. 40, further bounded and described as follows: Beginning on the West line of Sunset Drive, 60 feet wide, at the Northeast corner of land conveyed to Joseph A. Pawlak and Marie C. Pawlak by deed dated June 28, 1963 and recorded in Volume 10926, Page 671 of the Cuyahoga County Records; thence South 06 deg. 01' 50" East, along said West line of Sunset Drive, 150.83 feet to a point therein; thence West, 265.85 feet to a point; thence North, 150.00 feet to a point on the North line of land so conveyed to Joseph A. Pawlak and Marie C. Pawlak; thence East, along said North line of land so conveyed to Joseph A. Pawlak and Marie C. Pawlak, 250.00 feet to a point on the aforementioned West line of Sunset Drive and the principal place of beginning, according to a survey prepared for Joseph A. Pawlak dated May, 1971 by Seymour D. Weiss, Registered Surveyor No. 4759, be the same more or less, but subject to all legal highways.

    That this action in foreclosure proceedings is convened under provisions of Section 323.25 and/or Section 5721.18(a) and/or 323.65 - 323.79 of the Ohio Revised Code.

    Plaintiff prays that the defendants named above be required to appear on the date specified herein and set up their interest in said premises or be forever barred from asserting the same; that all taxes, assessments, penalties and interest due and unpaid, together with the costs of certificate of title, be found to be a good and valid first lien on said premises; that the Board of Revision make such order for payment of costs incurred herein together with $425.00 for the Preliminary Judicial Report; that the Board of Revision order said property to be sold according to law, or conveyed to an eligible township, municipality, county, or community development group pursuant to ORC 323.65 through 323.78 and that an Order of Sale or Order of Conveyance be issued to the Sheriff directing him to either advertise and sell the property at public sale in the manner provided by law; or, to convey the property to an eligible township, municipality, county, or community development group pursuant to ORC 323.65 through 323.78; that thereafter a report of such sale or conveyance be made by the Sheriff to the Board of Revision for further proceedings, if any, under law, and for such other relief as in law or equity this Plaintiff may be entitled.

    The defendants named above have the right to respond as set-forth by O.R.C 323.69(D)(1)(b).
