    BR 019004—Treasurer of Cuyahoga County, Ohio vs. Kevin Stewart, et al.

    Kevin Stewart, whose last known place of residence is 20507 Libby Road, Maple Heights, OH 44137, otherwise whose place of residence is unknown; the unknown heirs, devisees, legatees, assignees, executors, administrators and legal representatives of Kevin Stewart, the place of residence of each being unknown; Helen Stewart, whose last known place of residence is 315 Bonnieview #116, Bedford, OH 44146, otherwise whose place of residence is unknown; and the unknown heirs, devisees, legatees, assignees, executors, administrators and legal representatives of Helen Stewart, the place of residence of each being unknown, will take notice that on March 25, 2019, the undersigned, Treasurer of Cuyahoga County, Ohio, filed his complaint in the Board of Revision, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that by reason of default of the defendants in the payment of taxes, assessments, penalties and the interest upon real estate as delinquent the sum of $1,146.49 is due and unpaid and a first and prior lien against the following described real estate to wit:

    Permanent Parcel No. 126-38-013

    Situated in the City of Cleveland, County of Cuyahoga and State of Ohio: And known as being part of Sublot No. 23 in James W. Kingsbury's Subdivision of part of Original One Hundred Acre Lot Nos. 432 as shown by the recorded plat in Volume 6 of Maps, Page 8 of Cuyahoga County Records, bounded and described as follows:

    Beginning on the Westerly line of East 93rd Street, as its intersection with the Northerly line of the Manor Avenue S.E.;

    Thence Northerly along the Westerly line of said East 93rd Street, 48 feet to the Southeasterly corner of a parcel of land conveyed to Fannie Tillman by deed dated April 22, 1908 and recorded in Volume 1069, Page 564 of Cuyahoga County Records;

    Thence Westerly along the Southerly line of said parcel so conveyed to Fannie Tillman 90 feet to the Southwesterly corner of said parcel

    Thence Southerly along the Easterly line of a parcel of land conveyed to the Woodhill Building Co, by deeds dated August 12, 1940 and recorded in Volume 5128, Page 534 to 536 of Cuyahoga County Records, 48 feet to the Northerly line of Manor Avenue S.E.;

    Thence Easterly along the Northerly line of Manor Avenue, 90 feet to the place of beginning, be the same more or less, but subject to all legal highways.

    That this action in foreclosure proceedings is convened under provisions of Section 323.25 and/or Section 5721.18(a) and/or 323.65 - 323.79 of the Ohio Revised Code.

    Plaintiff prays that the defendants named above be required to appear on the date specified herein and set up their interest in said premises or be forever barred from asserting the same; that all taxes, assessments, penalties and interest due and unpaid, together with the costs of certificate of title, be found to be a good and valid first lien on said premises; that the Board of Revision make such order for payment of costs incurred herein together with $425.00 for the Preliminary Judicial Report; that the Board of Revision order said property to be sold according to law, or conveyed to an eligible township, municipality, county, or community development group pursuant to ORC 323.65 through 323.78 and that an Order of Sale or Order of Conveyance be issued to the Sheriff directing him to either advertise and sell the property at public sale in the manner provided by law; or, to convey the property to an eligible township, municipality, county, or community development group pursuant to ORC 323.65 through 323.78; that thereafter a report of such sale or conveyance be made by the Sheriff to the Board of Revision for further proceedings, if any, under law, and for such other relief as in law or equity this Plaintiff may be entitled.

    The defendants named above have the right to respond as set-forth by O.R.C 323.69(D)(1)(b).
