    BR 019786—Treasurer of Cuyahoga County, Ohio vs. Joseph A. Arcara, et al.

    Joseph A. Arcara, whose last known place of residence is 2412 East 39th Street, Cleveland, OH 44115, otherwise whose place of residence is unknown; and Unknown Spouse of Joseph A. Arcara, whose last known place of residence is 2412 East 39th Street, Cleveland, OH 44115, otherwise whose place of residence is unknown, will take notice that on May 31, 2019, the undersigned, Treasurer of Cuyahoga County, Ohio, filed his complaint in the Board of Revision, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that by reason of default of the defendants in the payment of taxes, assessments, penalties and the interest upon real estate as delinquent the sum of $1,727.79 is due and unpaid and a first and prior lien against the following described real estate to wit:

    Permanent Parcel No. 103-31-084

    Situated in the City of Cleveland, County of Cuyahoga and State of Ohio: And known as being all of Sublot Nos. 47, 48 and 50 and the Southerly 25 feet from front to rear of Sublot No. 52 in Chas. H. Norton's Allotment of part of Original Ten Acre Lot No. 44, as shown by the recorded plat in Volume 3 of Maps, Page 24 of Cuyahoga County Records, and together forming a parcel of land bounded and described as follows: Beginning on the Northerly line of Scovill Avenue S.E. (formerly Scoville Street) at its point of intersection with the Westerly line of East 39th Street (formerly Osborn Street); thence Westerly along said Northerly line of Scovill Avenue S.E., 106 feet 3 inches to the Southwesterly corner of said Sublot No. 47; thence Northerly along the Westerly line of said Sublot No. 47, 149 feet 10-1/2 inches to the Northwesterly corner thereof; thence Westerly along the Southerly line of said Sublot No. 50, 18 feet 11 inches to the Southwesterly corner thereof; thence Northerly along the Westerly line of said Sublot No. 50 and 52, 55 feet to the Southwesterly corner of land conveyed to Charles Wabel by deed dated March 25, 1873 and recorded in Volume 212, Page 226 of Cuyahoga County Records; thence Easterly along the Southerly line of land so conveyed to Charles Wabel, 125 feet to the Westerly line of East 39th Street; thence Southerly along said Westerly line of said East 39th Street, 199 feet 2 inches to the place of beginning, be the same more or less, but subject to all legal highways.

    Excepting therefrom that portion of land conveyed to Max Wurtenberg in Volume 584, Page 219 of Cuyahoga County Records and described as follows:

    Situated in the City of Cleveland, County of Cuyahoga and State of Ohio: And known as being Sublot No. Forty-eight (48) of Charles H. Norton's Subdivision of a part of Original Ten Acre Lot No. 44 in said City and is situated on the Northwest corner of Scoville Avenue and Osborn Street being 54.17 feet front on Scoville Avenue and extends back along Osborne Street, 144.17 feet, its West line being 147.08 feet in depth and is 54.08 feet wide in the rear as per plat of said Subdivision recorded in Volume 3 of Maps, Page 24 of Cuyahoga County Records, be the same more or less, but subject to all legal highways.

    Also excepting therefrom that portion of land conveyed to Max Wurtenberg in Volume 1043, Page 589 of Cuyahoga County Records and described as follows:

    Situated in the City of Cleveland, County of Cuyahoga and State of Ohio: And known as being Sublot No. 47 in Charles H. Norton's Allotment of a part of Original Ten Acre Lot No. 44, as shown by the recorded plat in Volume 3 of Maps, Page 24 of Cuyahoga County Records and being 52.08 feet front on the Northerly side of Scoville Avenue and 147.08 feet deep on the Easterly line and 149.96 feet deep on the Westerly line and 52 feet wide in the rear, be the same more or less, but subject to all legal highways.

    That this action in foreclosure proceedings is convened under provisions of Section 323.25 and/or Section 5721.18(a) and/or 323.65 - 323.79 of the Ohio Revised Code.

    Plaintiff prays that the defendants named above be required to appear on the date specified herein and set up their interest in said premises or be forever barred from asserting the same; that all taxes, assessments, penalties and interest due and unpaid, together with the costs of certificate of title, be found to be a good and valid first lien on said premises; that the Board of Revision make such order for payment of costs incurred herein together with $443.00 for the Preliminary Judicial Report; that the Board of Revision order said property to be sold according to law, or conveyed to an eligible township, municipality, county, or community development group pursuant to ORC 323.65 through 323.78 and that an Order of Sale or Order of Conveyance be issued to the Sheriff directing him to either advertise and sell the property at public sale in the manner provided by law; or, to convey the property to an eligible township, municipality, county, or community development group pursuant to ORC 323.65 through 323.78; that thereafter a report of such sale or conveyance be made by the Sheriff to the Board of Revision for further proceedings, if any, under law, and for such other relief as in law or equity this Plaintiff may be entitled.

    The defendants named above have the right to respond as set-forth by O.R.C 323.69(D)(1)(b).
