    894394—West Valley Plaza West, LLC vs. Felicia Dinkins, dba One Accord Innovations dba Liberty Tax Service, an Individual.

    Felicia Dinkins, whose last known place of residence is 9520 South Highland Ave., Garfield Heights, Ohio 44125, otherwise whose place of residence is unknown, will take notice that on March 12, 2018, the undersigned, West Valley Plaza West, LLC, filed its complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that on or about May 1, 2015, the lease for the premises located at 443A West Bagley Road, Unit A, Berea, 44017 (the "Property"), was assigned to Defendant, Felicia Dinkins, dba, One Accord Innovations dba Liberty Tax, ("FD"), by Bart Mercurio, dba Liberty Tax.

    Defendant, Felicia Dinkins, One Accord Innovations, LLC dba Liberty Tax Services executed the Assignment on or about June 16, 2015.

    Under the terms of the Lease, Defendant agreed to pay plaintiff rent for the premises for the term of the Lease $1,493.76 per month; plus common area charges of $198.00 per month; prorated real estate taxes; prorated insurance charges; utilities; and interest on any overdue amounts at 15% per annum or 3% per annum over the prime rate of KeyBank, unpaid utilities, and court costs.

    On or about August 31, 2016, Defendant was on a month to month tenancy with the Plaintiff and at the time owed the Plaintiff rental arrearages in the amount of $18,918.33.

    As a result of the breach, Defendant, Felicia S. Dinkins, an individual, currently owes plaintiff $18,918.33, at 15% interest from August 31, 2016 through to the present date, which includes her proportionate share of real estate taxes, insurance, CAM Charges, plus late charges.

    Defendant has been served by Plaintiff with a demand for payment of this debt, and to date Defendant, Felicia S. Dinkins has failed and refused to pay Plaintiff the monies due and owing pursuant to the lease.

    The outstanding current balance due to plaintiff for the debt of Felicia S. Dinkins is $18,918.33, plus 15% or 3% per annum over the prime rate of KeyBank, unpaid utilities, court costs and attorney fees.

    Wherefore, plaintiff requests judgment against Defendant, Felicia Dinkins, One Accord Innovations, dba Liberty Tax Service, an individual, for; a) money damages through the date of filing this complaint in the amount of $18,918.33; b) 15% interest per annum on all unpaid amounts from August 31, 2016 through to the date of judgment; c) Attorney Fees; and 4) costs of this action.

    The defendant named above is required to answer on or before the 28th day of September, 2018.
