    898951—U.S. Bank National Association, not in its individual capacity but solely as trustee for Flat Rock Mortgage Investment Trust vs. U.S. Bank Trust National Association, as Trustee of the PRP II Pals Investment Trust, et al.

    U.S. Bank Trust National Association, as Trustee of the PRP II Pals Investment Trust, whose last known place of business is 4600 South Syracuse Street, Suite 700, Denver, Colorado 80237, otherwise whose place of business is unknown, will take notice that on June 6, 2018, the undersigned, U.S. Bank National Association, not in its individual capacity but solely as trustee for Flat Rock Mortgage Investment Trust c/o Statebridge Company, LLC, filed its complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that the Defendant is the fee simple owner of the property described as follows:

    Situated in the City of Garfield Heights, County of Cuyahoga, and State of Ohio, and is described as follows:

    And known as being Sublot No. 240 in York Subdivision No. 2, being a Resubdivision of Blocks B, C, and E in York Subdivison No. 1, in Volume 45 of Maps, Page 8 of Cuyahoga County Records, being part of Original Independence Township Tract No. 2, East of the River, as shown by the recorded plat in Volume 146 of Maps, Page 20 of Cuyahoga County Records, as appears by said plat, be the same more or less, but subject to all legal highways.

    On or about July 18, 2014, a Complaint to Foreclose on the premises upon which there was a mortgage lien was filed having Case No. CV 14 830028. Upon sale in the Foreclosure action, the bid was assigned to the Defendant, wherein it was its intended that the bid be assigned to the Plaintiff which resulted in the property being conveyed to the Defendant; and that it was never the intent to have the Defendant become the titled owner of the real estate and that the property is inalienable due to the mistake in the name of titled owner.

    Plaintiff further says that this was due to an error on the part of Counsel, and now property has been vested into the name of an incorrect entity pursuant to a deed recorded in instrument number 201706230202 recorded June 23, 2017 in the Cuyahoga County Ohio recorder's office.

    Wherefore, Plaintiff requests an order from this court quieting title in the Plaintiff U.S. Bank National Association, not in its individual capacity but solely as trustee for Flat Rock Mortgage Investment Trust.

    The defendant named above is required to answer on or before the 1st day of October, 2018.
