    909964—Chippewa Place Development Company Limited Partnership vs. Unknown Successor or Assign of Brecksville Senior Citizens Housing Foundation Inc.

    Unknown Successor or Assign of Brecksville Senior Citizens Housing Foundation Inc., whose last known address and present address are unknown, will take notice that on January 22, 2019, the undersigned, Chippewa Place Development Company Limited Partnership, filed its complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that Plaintiff Chippewa Place Development Company Limited Partnership (hereinafter "Chippewa") is an Ohio limited partnership and the record owner of the real property located at 7005 Stadium Drive, Brecksville, Ohio 44141 and further identified as PPN 601-30-022 (the "Property"); that Brecksville Senior Citizens Housing Foundation, Inc. (hereinafter "BSCHF") is an Ohio non-profit corporation that was canceled by the Ohio Secretary of State by operation of law on October 22, 1990; that the Defendant in the instant action is the unknown successor or assign of BSCHF; that the reversionary interest held by BSCHF, or its successor or assign, has been abandoned as there is no successor or assign of BSCHF and such reversionary interest is no longer applicable to the subject Property; that the unknown successor or assign of BSCHF may claim an interest and estate in the subject Property adverse to Plaintiff, which claims are without any right and/or have been abandoned and constitute a cloud upon Plaintiff' s title to the subject Property.

    Wherefore, Plaintiff Chippewa Place Development Company Limited Partnership demands judgment as follows:

    1) Defendant, and all person claiming under it, be required to set forth the nature of their claims to the subject Property.

    2) All adverse claims to the subject Property be determined by a decree of this Court.

    3) That the decree adjudge that Plaintiff Chippewa Place Development Company Limited Partnership is the owner of the subject Property in fee simple, is entitled to the quiet and peaceful possession of the subject Property, and that Defendant, and all persons claiming under it, have no estate, right, title, lien, easement or interest in or to the subject Property or any part thereof.

    4) That the decree permanently enjoin the Defendant, and all persons claiming under it, from asserting any adverse claim to Plaintiff's title to the subject Property.

    The defendant named above is required to answer on or before the 3rd day of April, 2019.
