    915666—Mark Gronowski, et al. vs. Carlos Perez, Jr., et al.

    Carlos Perez Jr., whose last known place of residence is 1475 Lakewood Ave., Lakewood, OH 44107 and 11804 Detroit Rd., Lakewood, OH 44107 and 14931 Regency Dr., Strongsville, OH 44149, otherwise whose place of residence is unknown; Tonya Perez, whose last known place of residence is 1475 Lakewood Ave., Lakewood, OH 44107 and 11804 Detroit Rd., Lakewood, OH 44107 and 14931 Regency Dr., Strongsville, OH 44149, otherwise whose place of residence is unknown, will take notice that on May 21, 2019, the undersigned, Mark Gronowski, Mark Shenigo and The Cincinnati Insurance Company, filed their complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that on or about November 6, 2017, and at all times material herein, Plaintiff The Cincinnati Insurance Company (hereinafter "CIC") was the insurer, assignee and subrogee of Mark Gronowski and Mark Shenigo who were the owners of real property located at 1631 Lakewood Avenue, Lakewood, Ohio; that on or about April 29, 2014, Defendants Perez and Case entered into a Lease Agreement for the above referenced real property, said lease being in effect May 14, 2018; that on or prior to November 6, 2017, and at all times material herein, Defendants Perez occupied the real property at 1631 Lakewood Avenue, Lakewood, Ohio; that on or about November 6, 2017, Defendants Perez were evicted from 1631 Lakewood Avenue, Lakewood, and vacated the premises and negligently and/or intentionally caused damage to the real property of Gronowski and Shenigo; that as a direct and proximate result of the negligence and/or intentional actions of the Defendants Perez, Plaintiff CIC's insureds sustained damages in the amount of $9,015.32; that as a direct and proximate result of the negligence and/or intentional actions of the Defendants Perez, Plaintiff CIC paid to, or on behalf of, its insured the amount of $8,015.32 and became subrogated to said amount; that as a direct and proximate result of the negligence and/or intentional actions of the Defendants Perez, Plaintiffs Gronowski and Shenigo sustained a $1,000.00 deductible loss.

    Wherefore, Plaintiffs Mark Gronowski, Mark Shenigo and The Cincinnati Insurance Company demand judgment against Defendants Carlos Perez, Jr. and Tonya Perez, jointly and severally, in the amount of $9,015.32, interest at the statutory rate, and the costs of this action.

    The defendants named above are required to answer on or before the 9th day of September, 2019.
