915111—Greater Cleveland Regional Transit Authority v. Ashley Pondexter, et al.
Ashley Pondexter and Crystal Jefferson, whose last known place of residence is 2701 Division Avenue, Apartment 585, Cleveland, OH 44113, otherwise whose place of residence is unknown, will take notice that on May 9, 2019, the undersigned, Greater Cleveland Regional Transit Authority, filed its complaint in the Court of Common Pleas of Cuyahoga County, Ohio, alleging that GCRTA Transit Police Officer Brad Beaulieu drove a 2017 Ford Explorer, a Transit Police Vehicle, west bound in the first lane on Woodland Ave. at E. 66th St. on November 13, 2018 at approximately 12:08 p.m.; that there was a city garbage truck parked in the curb lane on Woodland Ave.; that as Beaulieu continued into the intersection, Defendant Pondexter also drove into the intersection driving Defendant Jefferson's 2009 Hyundai Sonata from E. 66th St. and collided with Beaulieu; that Pondexter pulled into the intersection without a clear view of oncoming traffic after stopping at a stop sign; that there was no stop sign for Beaulieu; that neither Pondexter nor Jefferson had motor vehicle insurance at the time of the accident; that Pondexter was driving without a valid license at the time of the accident; and that damages resulted from the Defendants' negligence because GCRTA suffered an overall loss in the totaling of their vehicle.
Plaintiff prays for judgment against Defendants for compensation for all general, special, incidental, and consequential damages suffered by the Plaintiff as a result of the Defendants's conduct; statutory prejudgment interest; reasonable attorneys' fees and costs, to the fullest extent allowed by law; and all such additional and further relief as the Court deems just and equitable.
The Defendants named above are required to answer on or before the 21st day of October, 2019.
