    931368—Ankur Goel vs. Nidhi Agrawal.

    Nidhi Agrawal, whose last known address is H.No. 3/6146, Opposite Dharamshala, Govind Vihar Colony, Sharanpur (U.P.) India 247001, otherwise whose address is unknown, will take notice that on March 24, 2020, the undersigned, Ankur Goel, filed his complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that on or about the 1st day of September, 2015, Plaintiff and Defendant, Nidhi Agrawal became owners as tenants in common, in fee simple with survivorship rights of the real property located at 3500 Kersdale Road, Pepper Pike, Ohio 44124 (hereinafter "the Property") and more fully described as:

    Situated in the City of Pepper Pike, County of Cuyahoga and State of Ohio, and known as being Sublot No. 369 in Van Sweringen Company's Belcourt Acres of part of Original Orange Township Lot Nos. 7 and 8, Tract 2, as shown by the recorded plat in Volume 140 of Maps, Page 24 of Cuyahoga County Records, as appears by said plat, be the same more or less, but subject to all legal highways.

    Plaintiff believes that a partition by sale of said property, rather than physical division, would be more equitable to the interest of the parties due to the impracticability of a physical division in such partition. Plaintiff is entitled to the proceeds of the partition action after payment of the mortgage lien; that the partition of the property and interest therein is in the best interest of the parties hereto and Plaintiff wishes to sever any relationship with Defendant Nidhi Agrawal; that the prosecution by Plaintiff of this partition action is for the common benefit of Plaintiff and Defendant, Nidhi Agrawal.

    Wherefore, Plaintiff prays for judgment granting partition by sale of the premises located at 3500 Kersdale Road, Pepper Pike, Ohio 44124, the debt and real estate taxes be paid, and the remaining proceeds of said partition be awarded to Plaintiff. Plaintiff further requests an award of all costs, attorney fees and any and all equitable relief against Defendant, Nidhi Agrawal and in favor of Plaintiff.

    The defendant named above is required to answer on or before the 1st day of June, 2020.
