938109—Comfort Keepers vs. Sarah Murrell.
Sarah Murrell, whose last known addresses are 11704 Princeton Avenue, Cleveland, Ohio 44105 and P.O. Box 605041, Cleveland, Ohio 44105, otherwise whose address is unknown, will take notice that on October 1, 2020, the undersigned, Comfort Keepers, filed its complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that on June 29, 2017, Defendant entered into a written contract with Plaintiff for Plaintiff to provide such in-home care services.
As of the date of this filing, Plaintiff has performed all of its obligations under the contract, and Defendant has failed to pay for such services.
Plaintiff has repeatedly demanded that Defendant pay the balance due of pursuant to the agreement.
Defendant has failed to perform its obligations under the agreement, and thus is liable for breach of such agreement.
Plantiff has been damaged by Defendant's intentional acts and failure to give reasonable notice, and Defendant should be liable for costs and attorney fees.
Defendant's actions have caused Plaintiff damages in the amount of $11,996.25, and Defendant is thus liable for this amount.
Wherefore, Plaintiff, Comfort Keepers, prays that this Honorable Court enter a judgment against the Defendant Sarah Murrell as follows:
a. As to Count I, judgment in the amount of $11,996.25;
b. As to Count II, judgment in the amount of $11,996.25, plus reasonable costs and attorney fees herein;
c. As to Count III, judgment in the amount of at least $11,996.25, plus reasonable costs and attorney fees herein;
d. As to County IV, judgment in the amount of $11,996.25, plus interest, reasonable costs and attorney fees herein;
e. Prejudgment and post-judgment interest on all of the above; and
f. Such other relief as this Honorable Court deems equitable and just.
The defendant named above is required to answer on or before the 28th day of June, 2021.
