    940826—Mary Eldridge vs. Builders Group, Inc.

    Builders Group, Inc., whose last known address and present address are unknown; and David Morrow, Owner, whose last known address and present address are unknown, will take notice that on December 3, 2020, the undersigned, Mary Eldridge, filed her petition to release Mechanic's Lien in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that Petitioner is the owner of real property ("the property") located at 3613 Lee Rd., Shaker Hts., OH 44120 as described as follows:

    Situated in the City of Shaker Heights, County of Cuyahoga and State of Ohio and known as being:

    Sublot No. 114 in a resubdivision of part of the Van Sweringen Company's Subdivision #21 of part of the Original Warrensville Township Lot #53, as shown by the recorded plat Vol. 65 of Maps, Page 22 of Cuyahoga County Records, and being 40 feet front on the Easterly side of Lee Road, and extending back of equal width 140 feet deep, as appears by said plat, be the same more or less, but subject to all legal highways

    At all times relevant herein, Respondent Mary Eldridge was, and now is, the owner of the above described property who contracted with Respondent, Builders Group Inc. to perform work concerning the property.

    The contracted work was performed on or about September 6, 2004.

    On or about June 20, 2005, Respondent recorded a claim of mechanics lien against the property. The lien was recorded in the official records of the County Recorder in book number, 65 page number 22. The claim of lien was in the amount of $6,163.00 for labor, services, equipment, or materials furnished by Respondent for a work of improvement.

    Respondent is unable to execute a release of the lien, as the business is no longer in existence as a result of the death of its owner David Morrow.

    Due to the Death of Mr. Morrow, Petitioner was unable to send Respondent a written demand to remove the lien.

    Wherefore, Petitioner prays for judgment against Respondent as follows:

    1. That the real property described above be released from Respondent's claim of lien;

    2. Such other relief as may be just.

    The defendants named above are required to answer on or before the 9th day of August, 2021.
