950258—Harley-Davidson Credit Corp., as assignee of Eaglemark Savings Bank vs. Aaron N. Johnson.
Aaron N. Johnson, whose last known place of residence is 1020 East 179th Street, Cleveland, Ohio 44119, otherwise whose place of residence is unknown, will take notice that on July 21, 2021, the undersigned, Harley-Davidson Credit Corp., as assignee of Eaglemark Savings Bank, filed its complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that Defendant, Aaron N. Johnson executed a Promissory Note and Security Agreement (hereinafter ‘Contract') on June 28, 2019 for the purpose of purchasing a motorcycle from Plaintiff in the original amount of $26,496.62; that the balance currently due and owing on said contract is $26,861.30; that Defendant is in default of said Contract by failing to make payments as required; that Plaintiff is entitled to immediate possession of the vehicle by virtue of Defendant's default of the Contract and by virtue of the fact Plaintiff has a secured interest in the collateral as the first lien holder; that for the reasons set forth in the Affidavit and Motion for Possession, the Plaintiff is entitled to immediate right of possession of the described collateral.
Plaintiff requests an order from this Court permitting it to replevin said collateral for the reasons stated herein.
The defendant named above is required to answer on or before the 23rd day of November, 2021.
