954596—Tammy Miller, et al. vs. Derrick Owens.

Derrick Owens, whose last known place of residence is 17210 Judson Drive, Cleveland, OH 44128, otherwise whose place of residence is unknown, will take notice that on October 19, 2021, the undersigned, Tammy Miller and Rayshon Robinson, filed their complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that Plaintiff Miller is the equitable owner and is in possession of the Property known as 17210 Judson Avenue, Cleveland, OH PPN Number 141-11-047, Legal Description 73 Adler 0024 ALL; that the Defendant Owens" fraud, misrepresentation and breach of oral contract places a cloud on Defendant Owens' purported title which entitled the Plaintiff Miller to have the Defendant Owens removed from the deed and, with the consent of Plaintiff Rayshon Robinson, have full title replaced solely in the name of the Plaintiff Miller, pursuant to O.R.C. 5303.01.

Plaintiffs, Tammy Miller and Rayshon Robinson, demand Judgment as follows:

1. That this Honorable Court issue an Order granting a Declaratory Judgment and quieting to Plaintiff Tammy Miller a full title to the Property, award her the costs incurred herein, and all other legal and equitable relief as this Court deems just and proper.

2. That this Honorable Court set aside, invalidate and rescind the deed from this Void Conveyance, the costs incurred herein, and all other legal and equitable relief as this Court deems just and proper.

3. That this Honorable Court grant a Monetary Judgment to Plaintiffs against the Defendant Derrick Owens in an amount in excess of $25,000.00, including compensatory and punitive damages, plus reasonable legal fees, interest and costs, and/or other legal and equitable relief as this Court deems just and proper.

4. Any and all other relief to which the Plaintiffs may be entitled to in law, justice, equity and/or their best interest.

The defendant named above is required to answer on or before the 30th day of December, 2021.
