    952502—S. Sandy Satullo vs. Joan L. Adam, Administrator for the Estate of John T. Adam, et al.

    Joan L. Adam, Administrator of the Estate of John T. Adam, whose last known address is 928 Sea Sage Drive, Delray, Florida 33483, otherwise whose address is unknown, will take notice that on August 31, 2021, the undersigned, S. Sandy Satullo, filed her complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that On December 28, 1993, Adam entered into an Assignment and Assumption of Boat Slip Lease with S. Sandy Satullo to assign any and all interest Adam has pursuant to the Lease with Newport for Boat Slip No. 115 which was filed for record with the Cuyahoga County Recorder at Volume 93-10678, Page 10 ("Assignment").

    The Assignment, however, was never recorded with the Cuyahoga County Recorder.

    Plaintiff brings this action to quiet title and to obtain an order to record the Assignment to Plaintiff and to allow the Assignment to be recorded with the Recorder's Division of the Cuyahoga County Fiscal Office. Absent this claim to quiet title and bringing this action, Plaintiff is unable to record his interest in the property.

    Plaintiff pursuant to O.R.C. § 5303.01 and equitable estoppel, seeks an order that required the Boat Slip Lease to be assigned to him and to permit the Assignment to be recorded at the Recorder's Division of the Cuyahoga County Fiscal Office.

    Plaintiff, S. Sandy Satullo, prays for a judgment in his favor and requests the following relief against Defendants:

    1. That the Court issue an order quieting title and finding that the Assignment is a valid assignment of the Boat Slip Lease.

    2. That the Court issue a declaration and determination that Plaintiff is the rightful lessee of the Boat Slip Lease and that Defendant, Estate of John T. Adam, be declared to have no right, title or interest in the Boat Slip Lease;

    3. That the Court issue an order directing the Recorder's Division of the Cuyahoga County Fiscal Office to record the Assignment; and

    4. For such other and further relief as the Court may deem proper.

    The defendant named above is required to answer on or before the 31st day of December, 2021.
