Case Number: 19-CV-524 In The Matter of the Complaint of Thomas F. Springer, as owner of a 2007 Yamaha VX110 Deluxe Personal Watercraft, for Exoneration from or Limitation of Liability. Notice is given that Limitation Plaintiff, Thomas F. Springer (hereinafter the "Limitation Plaintiff"), has filed a Complaint in Admiralty, pursuant to 46 U.S.C. §§ 30501 et seq., claiming the right of exoneration from or limitation of liability for any and all claims arising out of the operation of his Yamaha VX110 Deluxe personal watercraft (Hull Identification Number: YAMA4264E707) (hereinafter, the "Limitation Vessel"), on Lake Erie near Madison, Ohio, on or about July 24, 2016. All persons having claims must file them as provided in Rule F of the Supplemental Rules for Admiralty or Maritime Claims and Asset Forfeiture Actions, Federal Rules of Civil Procedure, with the Clerk of this Court, the United States District Court for the Northern District of Ohio, and serve on or mail to the Limitation Plaintiff's counsel, Christopher A. Abel, Esquire, Wilcox and Savage, P.C. 440 Monticello Avenue, Suite 2200, Norfolk, Virginia 23510 or to Markus E. Apelis, Esquire, Gallagher Sharp, LLP, 1501 Euclid Avenue, Fl. 6, Cleveland, Ohio 44115, a copy thereof on or before the 15th day of May, 2019, or be defaulted. Personal attendance is not required. Any claimant desiring to contest the Limitation Plaintiff's allegations must file an answer to the Complaint as require by Rule F (5) of the Supplemental Rules for Admiralty or Maritime Claims and Asset Forfeiture Actions, Federal Rules of Civil Procedure, and serve on or mail to either counsel for Limitation Plaintiffs a copy thereof.
