19 CVG-001193—Berliner Holdings LLC vs. Arpil Artz.
April Artz, whose last known place of residence is 9414 Bancroft Avenue, Cleveland, Ohio 44105, otherwise whose place of residence is unknown, will take notice that on January 23, 2019, the undersigned, Berliner Holdings LLC, filed its complaint in the Cleveland Municipal Court, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that Plantiff is the owner of certain real property located 9414 Bancroft Avenue, Cleveland, Ohio 44105 (the "Premises"); that Defendant has been occupying said Premises pursuant to an oral lease commencing on or about October 1, 2018; that Defendant has breached provisions of her tenancy by failng to make the rental payments; that on January 3, 2019, Plaintiff duly served upon Defendant, as required by Section 1923.04 of the Ohio Revised Code, notice is writing to leave the Premises; that Defendants are unlawfully and forcible detaining possession of the Premises from Plaintiff who is entitled to said possession.
Defendant is currently required to pay rent of $600.00 per month. Defendant currently owes $2,400 of back rent plus late fees. Rent is also claimed at the rate of $600.00 per month until Defendant vacates the premises and for the balance of the lease term.
Plaintiff also claims damage to the premises by Defendants and seeks reimbursement therefore in an amount to be proved at trial.
Wherefore, the Plaintiff prays for judgment on Count One and for judgment on Count Two in an amount not to exceed $15,000.00 for back rent, additional rent until the premises is vacated and rent for the balance of the lease and damage to the premises in an amount to be proved at trial, plus interest at the statutory rate from the date of judgment and such other and further relief as this Court may deem just and proper.
The defendant named above is required to answer on or before the 16th day of July, 2019.
