    2019 ADV 245661—Charlotte D. Pastula, Guardian of Irene L. Pawlowski v. Charlotte D. Pastula, Guardian of Irene L. Pawlowski

    Anthony Adams, whose last known place of residence and present place of residence are unknown, will take notice that on August 7, 2019, the undersigned, Charlotte D. Pastula, Guardian of Irene L. Pawlowski, filed her complaint in the Probate Court, 1 Lakeside Avenue, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that the Ward is seized in fee simple of the following real estate located at 643 Tollis Parkway, Broadview Heights, Ohio 44147:

    Permanent Parcel No. 581-22-518

    Situated in the City of Broadview Heights, County of Cuyahoga and State of Ohio, and being Unit No. 57, Building No. 7, of Pine Crest Condominium Townhouses Group G, as the same is numbered, designated, and described in the Declaration and By-Laws of and on the drawings of said Condominium, of record, respectively, in Volume 13162, Pages 899 et seq., inclusive of the Deed Records, and Volume 15, Pages 12 through 13, inclusive of the Condominium Map Records in the Recorder's Office of Cuyahoga County, Ohio; and as the same is numbered, designated and described in the First Amendment to said Declaration and By-Laws of and on the drawings of said Condominium which Amendment is recorded in Volume 13303, Pages 607 et seq., of the Deed Records, and Volume 16, Pages 73 and 74, inclusive, of the Condominium Map Records in the Recorder's Office of Cuyahoga County, Ohio; and as the same is numbered, designated an described in the Second Amendment to said Declaration and By-Laws of and on the drawings of said Condominium which Amendment is recorded in Volume 13360, Pages 693 et seq., of the Deed Records, and Volume 19, Pages 1 and 2, inclusive, of the Condominium Map Records in the Recorder's Office of Cuyahoga County, Ohio; and as the same is numbered, designated an described in the Third Amendment to said Declaration and By-Laws of and on the drawings of said Condominium which Amendment is recorded in Volume 13626, Pages 963 et seq., of the Deed Records, and Volume 21, Pages 74 and 75, inclusive, of the Condominium Map Records in the Recorder's Office of Cuyahoga County, Ohio.

    Together with an undivided percentage interest in the Common Areas and Facilities appurtenant to said Unit as set forth in said Declaration, as the same may be amended from time to time, which percentage interest shall automatically change in accordance with amended Declarations as the same are filed of record pursuant to said Declaration, will attach to the additional Common Areas and Facilities described in such amended Declarations, and shall be deemed to have been conveyed effective on the recording of each such amended Declaration as though conveyed hereby.

    and the By-Laws of Pine Crest Condominium Townhouse Group G Unit Owner's Association, and any administrative rules and regulations which may be adopted pursuant thereto, as any of the same may be lawfully amended from time to time.

    Subject to all legal highways, conditions, restrictions, easements and zoning regulations of record, and to real estate taxes and assessments, if any, that are and will be a lien on said Unit which are not yet due and payable.

    Plaintiff further states that it is in the best interest of the Ward, who is currently residing at Arden Courts of Parma memory care facility, that this real estate be sold; and that the real estate has a stated value of $85,000.00 in the Inventory based upon County value which was filed and approved by the Court. The property has yet to be appraised.

    Plaintiff prays that she be authorized to sell and/or transfer the property free of all claims, interest, liens, and right of expectancy of dower therein of all such persons to this action; that the Court determine the liens and equity claims of the parties and their priority; and that the Court issue an order authorizing the transfer of the property free and clear of all liens and encumbrances; and for such other and further relief which the Court deems proper.

    The defendant named above is required to answer on or before the 21st day of November, 2019.
