2020 ADV 250800—Egidijus Marcinkevicius, Guardian of the person and estate of Rose M. Lonero, Incompetent vs. Egidijus Marcinkevicius, Guardian of Rose M. Lonero, Incompetent, et al.
Unknown Heirs or Rose M. Lonero, Incompetent, the place of residence of each being unknown, will take notice that on March 3, 2020, the undersigned, Egidijus Marcinkevicius, Guardian of the person and estate of Rose M. Lonero, Incompetent, filed his complaint in the Probate Court, 1 Lakeside Avenue, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that the ward is seized in fee simple of the real property located in Cuyahoga County, Ohio and commonly known as 5850 Maureen Drive, Seven Hills, Ohio 44121 and further described as follows:
Situated in the City of Seven Hills, County of Cuyahoga, and State of Ohio, and known as being a part of Sublot No. 1 in the Willowbrook Subdivision No. 2, as shown by the recorded plat in Volume 175, Page 13 of Maps of Cuyahoga County Records and part of a parcel of land conveyed to Steven L. Ludwinski by deed dated December 8, 1959 and recorded in Volume 9907, Page 161 of Cuyahoga County Records, of part of Original Independence Township Lot No. 16, Tract 2, and together forming a parcel of land bounded and described as follows: Beginning on the Westerly side of Maureene Drive (60 feet wide) at the Southwesterly corner of land conveyed to Joe Kresz by deed dated May 13, 1963, and recorded in Volume 10904, Page 351 of Cuyahoga County Records; thence Westerly along the Southerly line of land so conveyed to Joe Kresz to its intersection with the Northern prolongation of the Westerly line of land conveyed to Steven L. Ludwinski by deed dated December, 1959, and recorded in Volume 9907, Page 160 of Cuyahoga County Records; thence Southerly along said prolongation and the Westerly line of land conveyed to Steven L. Ludwinski 142 feet; thence Easterly right angles to the Westerly line of land conveyed to Steven L. Ludwinski about 95 feet to the Westerly side of Maureene Drive (60 feet) wide; thence Northerly along the westerly side of Maureene Drive about 142 feet to the principal place of beginning; and as part of the Provide Proper Drainage for the Field Tile, if any, now crossing this parcel and consideration the Grantees agree to a storm sewer easement across the Southerly portion of land being conveyed; this easement shall be in force until storm sewer facilities are available on Rockside Road for use by the property to the West of subject parcel, be the same more or less, but subject to all legal highways.
It is necessary to sell the real estate for the following reasons:
(a) to pay the debts of the ward and for her room and board;
(b) The sale will be for the benefit of the Ward.
Wherefore, Plaintiff demands that the real estate be sold; that the rights, interests and liens of all parties may be fully determined, adjudged and protected, and that the plaintiff be authorized and ordered to sell the real estate according to the statutes in such case made and provided, and for such other relief as he may be entitled.
The defendants named above are required to answer on or before the 7th day of May, 2020.
