20CVG02711—Apple Creek MHC, LLC vs. Karen Hanusek, et al.
Lawrence Lengyel and The Estate of Lawrence Lengyel whose last known address is 26240 Broadway Avenue, Lot 3, Oakwood Village, Ohio 44146, will take notice that on August 24, 2020, the undersigned, Apple Creek MHC, LLC, filed its complaint in the Bedford Municipal Court, 165 Center Road, Bedford, Ohio 44146, of Cuyahoga County, Ohio alleging that the Defendants occupy the captioned premises pursuant to an oral month-to-month lease; that the Defendants have unlawfully failed and refused to pay the sum of $294.00 due for January 2020 rent for the premises, and no payments have been made since. In additions, the Defendants carried a previous balance of unpaid rent.
On March 16, 2020, Plaintiff served Defendants a 30-day notice to terminate lease and vacate premises. Defendants did not vacate the premises so on June 17, 2020 Plaintiff served Defendants with a written three-day notice to leave the premises as required by Ohio Revise Code Section 1923.04.
To date, Defendants have failed to vacate the premises.
Wherefore, Plaintiffs demand judgment against Defendants, as follows:
1. Plaintiff demands judgment against Defendants for immediate restitution of the premises and for authority for Plaintiff to permit, in accordance with section 1923.12 and division (B) of section 1923.12 and division (B) of section 1923.14 of the Revised Code, the removal from the manufactured home park and potential sale, destruction, or transfer of ownership of the Defendant's manufactured home.
2. Reasonable costs, interest, and any other relief this Court deems just and equitable.
The defendants named above are required to answer on or before the 18th day of November, 2020.
