    900442—Mohammed Yunis, et al. vs. Thomas Phillips, et al.

    Thomas Phillips, whose last known place of residence is 1772 East 47th St., Cleveland, OH 44103, otherwise whose place of residence is unknown; Teresa Phillips whose last known place of residence is 1772 East 47th St., Cleveland, OH 44103, otherwise whose place of residence is unknown, will take notice that on October 8, 2018, the undersigned, Mohammed Yunis and Janeen Ayad, filed their first amended complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that on or about February 8, 2017, at approximately 10:55 a.m., Plaintiff was operating a motor vehicle on I-90 East approaching the Chester Road exit in Cleveland, Ohio; that at the same time and place, Defendant Teresa Phillips and/or Defendant Thomas Phillips negligently and recklessly operated her/his vehicle by failing to maintain an assured clear distance, while striking the rear end of Plaintiff's vehicle; that as a direct and proximate result of the negligence of Defendants Teresa Phillips and/or Defendant Thomas Phillips, Plaintiff suffered serious and painful personal injury, incur expenses for medical care and treatment, and has suffered a lost of earning and earning capacity.

    Defendant Thomas Phillips knew or should have known that Defendant Teresa Phillips is an incompetent driver and despite this knowledge, negligently entrusted Defendant Teresa Phillips with the operation of his motor vehicle; that as a direct and proximate result of the negligence of Defendant Teresa Phillips and/or Defendant Thomas Phillips suffered personal injuries, incur expenses for medical care and treatment, and has suffered a lost of earning and earnings capacity.

    At all times relevant herein, Janeen Ayad was the spouse of Plaintiff Mohammed Yunis; that as a direct ad proximate result of the negligence of the Defendant Teresa Phillips and/or Defendant Thomas Phillips, Plaintiff Ayad sustained a loss of the companionship and consortium of her spouse, Plaintiff.

    Plaintiffs pray for damages against Defendants in an amount greater than $25,000 which sum will fairly and fully compensate them pursuant to all applicable laws together with pre- and post-judgment interest, attorney's fees, and the cost of this action.

    The defendants named above are required to answer on or before the 19th day of February, 2019.
