941799—Michael Dudich, et al. vs. Robert Lee Chapman, et al.
Robert Lee Chapman, whose last known place of residence is 21001 Kenyon Drive, Maple Heights, Ohio 44137, otherwise whose place of residence is unknown, will take notice that on December 21, 2020, the undersigned, Michael Dudich and Stacey Dudich, filed their complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that on or about December 27, 2018, Michael Dudich was in the City of Cleveland, County of Cuyahoga and State of Ohio, crossing Shaker Boulevard at the intersection of E. 116th Street and while in the cross walk, he was struck by a vehicle which was recklessly and/or negligently operated by Defendant, Robert Lee Chapman; that Defendant Robert Lee Chapman, was an employee and/or agent of the City of Cleveland and/or Office of the Mayor of Cleveland at the time of the accident; that Defendant Robert Lee Chapman, was operating his vehicle as an individual and/or in the course and scope of his employment with the City of Cleveland and/or Office of the Mayor of Cleveland at the time of this incident; that further, Plaintiff, Michael Dudich states that as a direct and proximate result of the recklessness and/or negligence of Defendant, Robert Lee Chapman, acting as an individual and/or in the course and scope of his employment with Defendants, City of Cleveland and/or Office of the Mayor of Cleveland, has sustained injuries to his person, lost time and wages and incurred expenses for his medical care and attention.
Plantiff Stacey Dudich states that she is the wife of the Plaintiff, Michael Dudich; that as a direct and proximate result of the recklessness and/or negligence of the Defendants, she has been deprived of her husband's services and consortium and believes and therefore avers that she will be so deprived in the future.
Wherefore, Plaintiffs, Michael Dudich and Stacey Dudich, pray for judgment against the Defendants, Robert Lee Chapman and/or the City of Cleveland and/or the Office of the Mayor of Cleveland, jointly and/or severally, pursuant to Count I and Count II, in an amount in excess of $25,000.00 in compensatory damages together with interest and costs incurred herein and any other relief which the Court deems appropriate.
The defendant named above is required to answer on or before the 28th day of July, 2021.
