944515—Dayveon A. Drake vs. Cleveland Heights Police Department, et al.
Officers Thomas D. Clementi and Jaycie L. Brown, the place of residence of each being unknown, will take notice that on February 26, 2021, the undersigned, Dayveon A. Drake, filed his complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that this civil rights action challenges the gratuitous excessive, and objectively unreasonable force used against Dayveon A. Drake who was a lawful retail invitee at the Marc's Neighborhood Store located at 1833 Conventry Road, Cleveland Heights, Cuyahoga County, Ohio, when off-duty Cleveland Heights Police Officer, Thomas C. Harris, who was working as a security officer in the Marc's store, accosted Plaintiff, including calling in other Cleveland Heights Police Officers, and assaulted Plaintiff, causing severe injuries to his person. This action seeks to address the misconduct that caused Dayveon Drake's injuries and damages.
Wherefore, Plaintiff requests this Court to award him:
A. Compensatory damages in an amount greater than $75,000.00;
B. Punitive damages in an amount to be shown at trial;
C. Reasonable attorney fees;
D. Prejudgment interest;
E. Costs incurred in this action;
F. Such other and further relief as the Court may deem just and proper.
The defendants named above are required to answer on or before the 19th day of August, 2021.
