    2018 ADV 236943—Franklin C. Malemud, Admr. of the Estate of George Broaden, Deceased vs. The Unknown Next of Kin of George Broaden, Deceased, et al.

    The unknown next of kin of George Broaden, deceased, the place of residence of each being unknown, will take notice that on August 21, 2018, the undersigned, Franklin C. Malemud, as Fiduciary of the Estate of George Broaden, deceased, filed his complaint in the Probate Court One Lakeside Avenue, N.W., of Cuyahoga County, Ohio, alleging that George Broaden died a resident of Cuyahoga County, Ohio on January 27, 2004; that Plaintiff, Franklin C. Malemud, Esq., was appointed by the Cuyahoga County Probate Court in Case No: 2018EST232215 as the Administrator of the Estate of George Broaden, deceased (the "Estate") on April 12, 2018; that to the knowledge of Mr. Malemud as Administrator of the Estate (the "Administrator"), the decedent did not leave a Will; that this Complaint seek an order of this Court appointing a Trustee for Suit to represent the interests of the unknown next of kin/heirs at law of George Broaden, deceased, to determine the identity of the next of kin/heirs at law of George Broaden, deceased and to fix their respective shares of the net distributable Probate Estate.

    Wherefore, Franklin C. Malemud, Esq. as Administrator of the Estate of George Broaden, deceased, hereby moves the Court for the following relief on this Complaint for Determination of Heirs:

    A. An Order appointing a Trustee for Suit to represent the unknown next of kin/heirs at law of George Broaden, deceased.

    B. An order identifying the next of kin/heirs at law of George Broaden, deceased.

    C. An order fixing the interests in the net distributable Probate Estate of any Court determined next of kin/heirs at law of George Broaden, deceased.

    D. An order finding that this Complaint was brought in good faith and in the best interests of the Estate.

    E. For all other appropriate relief available under the law, facts and equities of the case.

    The defendants named above are required to answer on or before the 22nd day of January, 2019.
