    908246—Founders Insurance Company vs. Goldie Taylor Carnegie, et al.

    Tyrell Minger and Moranda Hampton, whose last known place of residence and present place of residence are unknown, will take notice that on December 11, 2018, the undersigned, Founders Insurance Company, filed its complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that or or about February 13, 2016, Defendant Shantia Nata Bradford was operating an automobile owned by Defendant Tyler Minger, when she was in the process of making a left-hand turn from East 131st Street onto Harvard Avenue in the City of Cleveland, County of Cuyahoga, State of Ohio; that at the same time and place, in the automobile being operated by Defendant Bradford were Defendants Tyler Minger and Zitaya Myers; that at the same time and place, Defendant Goldie Taylor Carnegie was operating an automobile heading southbound on E. 131st Street, and Defendants Ramaya Phillips, Christopher Foster, and Moranda Hampton were passengers in said vehicle; that various Defendants have alleged or indicated that as a result of Defendant Bradford commencing a left-hand turn onto Harvard Avenue, there was a collision between the vehicles being operated by Defendants Bradford and Taylor Carnegie; that it is believed that all the Defendants, including all specifically named herein and the John Does 1-3 and John Doe Companies 1-3, sustained damages and/or injuries as a result of the February 13, 2016 automobile accident.

    Whrefore, Plaintiff Founders Insurance Company prays for and requests an Order that states the following:

    A. Defendant Shantia Bradford was operating an automobile owned by Defendant Minger at the time February 13, 2016 automobile accident;

    B. The automobile Defendant Shantia Bradford was operating at the time of the February 13, 2016 automobile accident is not listed on the Declarations as a vehicle covered under Founders Insurance Company Policy No. ITOH138247;

    C. The automobile that Shantia Bradford was operating at the time of the February 13, 2016 automobile accident does not qualify as "your insured car" under Founders Insurance Company Policy No. ITOH138247;

    D. Founders Insurance Company Policy No. ITOH138247 does not afford any liability coverage to Defendants Bradford and Minger for the February 13, 2016 automobile accident;

    E. Founders Insurance Company Policy No. ITOH138247 does not afford any liability coverage, defense, or indemnity to any Defendant for the February 13, 2016 accident involving Defendants Bradford, Minger, Taylor, Carnegie, Hampton, Phillips, Foster, and Myers, and Founders Insurance Company is not required to defend or indemnify or hold harmless any Defendant in any lawsuit or legal proceeding or arbitration or for any claim or demand or allegation stemming from the February 13, 2016 automobile accident;

    F. Plaintiff Founders Insurance Company is not required to defend, hold harmless, or indemnify Defendants Bradford or Minger in the matter of Goldie Taylor Carnegie v. Grange Insurance, et al., Cuyahoga County Common Pleas Court, Case No. CV 18 891859, or in lawsuit or legal proceeding or arbitration or for any claim,. demand or allegation stemming from the February 13, 2016 automobile accident;

    G. The Declarations for Founders Insurance Company Policy No. ITOH138247 does not list any premium as being paid for Medical payment coverage.

    H. Founders Insurance Company Policy No. ITOH138247 doe no afford any Medical Payment coverage to any Defendant for the February 13, 2016 automobile accident;

    I. The Declarations for Founders Insurance Company Policy No. ITOH138247 does not list any premium as being paid for Uninsured/Underinsured Motorist coverage;

    J. Founders Insurance Company Policy No. ITOH138247 does not afford any Uninsured/Underinsured Motorist Coverage to any Defendant for the February 13, 2016 automobile accident;

    K. Plaintiff Founder Insurance Company is not obligated to pay any moneys to or on behalf of Defendants Bradford, Minger, Taylor Carnegie, Hampton, Phillips, Foster, Myers, Grange Insurance, USAA Insurance, Ohio Medicaid, John Does 1-3, and John Doe Companies 1-3 as a result of the February 13, 2016 automobile accident;

    L. Founders Insurance Company Policy No. ITOH130738 does not provide any type of insurance coverage to Defendants Bradford, Minger, Taylor Carnegie, Hampton, Phillips, Foster, Myers, Ohio Medicaid, Grange Insurance, USAA Insurance, John Does 1-3, and John Doe Companies 1-3 for the February 13, 2016 automobile accident;

    M. Defendants, individually and collectively, pay Court costs in this matter; and

    N. For any all other relief that this Court deems proper.

    The defendants named above are required to answer on or before the ^ day of ^, 2019.
