    2019 ADV 240524—Stanley G. Harris, Administrator DBN WWA of the Estate of Mary Szoke, deceased vs. Stanley G. Harris, et al.

    Unknown Beneficiaries of a Trust for which Mary Szoke is or may be the Trustee, the place of residence of each being unknown, will take notice that on January 24, 2019, the undersigned, Stanley G. Harris, Administrator DBN WWA of the Estate of Mary Szoke, deceased, filed his complaint in the Probate Court One Lakeside Avenue, N.W., of Cuyahoga County, Ohio, alleging that on May 22, 2003 The Last Will and Testament of Mary Szoke was admitted to probate and Veronica Clara Graf was appointed as executor.

    Veronica Clara Graf died 1/10/2017 and Stanley G. Harris executor of her estate, has been appointed a Administrator DBN WWA of the estate of Mary Szoke.

    On Mary 17, 1999 Louis Szoke and Mary Szoke transferred by quit claim deed to "Mary Szoke, Trustee" title to their real estate at 3826 West 162nd Street in Cleveland, Ohio, and more fully described as being situated in the City of Cleveland, County of Cuyahoga and State of Ohio:

    And known as Sub Lot No. 3 in John Olderman Realty Pasadena Park Subdivision of Original Rockport Township Sections Nos. 8, 9, 12, and 13, as shown by the original plat in Volume 56 of Maps, Page 33 of Cuyahoga County Records, and being 50 front on the Southwesterly side of West 162nd Street and extending back 141.62 feet on the Northerly line 157.15 feet on the Southerly line and having a rear line of 55.30 feet, as appears by said plat, be the same more or less, but subject to all legal highways.

    Subject to zoning ordinances, and restrictions and easements of record, if any. PPN: 025-27-013.

    Mary Szoke died March 17, 2003. The said quit claim deed to "Mary Szoke, Trustee" contained no language identifying any trust for which Mary Szoke was the trustee. No trust document was ever found by the fiduciary of her estate among her personal papers. There is no way to determine if there ever was a trust document, or who is/are beneficiaries of the trust.

    Wherefore, in order for a proper disposition to be made of the property at 3826 West 162nd Street in Cleveland, Ohio, it is demanded that the said property be declared to be an asset of Mary Szoke herself; and that the said property be included in the estate of Mary Szoke as a newly discovered asset.

    The defendants named above are required to answer on or before the 7th day of May, 2019.
