920550—Treasurer of Cuyahoga County, Ohio vs. Unknown Heirs, etc. of Donald A. Smith, Jr., et al.
The unknown heirs, devisees, legatees, assignees, executors, administrators and legal representatives of Donald A. Smith, Jr., the place of residence of each being unknown, will take notice that on August 28, 2019, the undersigned, Treasurer of Cuyahoga County, Ohio, filed his complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that by reason of default of the defendants in the payment of taxes, assessments, penalties and the interest upon real estate as delinquent the sum of $110.22 is due and unpaid and a first and prior lien against the following described real estate to wit:
Permanent Parcel No. 134-13-031
Situated in the City of Cleveland, County of Cuyahoga and State of Ohio and known as being Sublot Nos. 37 and 38, and part of Beman Avenue, SE, as vacated by City Ordinance 6269, in Stanley and Adams Subdivision of part of Original One Hundred Acre Lot Nos. 463 and 464, as shown by the recorded plat in Volume 11 of Maps, Page 39 of Cuyahoga County Records and together forming a parcel of land bounded and described as follows: Beginning at the intersection of the Southerly line of Beman Avenue, SE, formerly Beman Street, 50 feet wide, with the Easterly line of said Sublot No. 27; thence Northerly along the Northerly prolongation of the Easterly line of said Sublot No. 37, which is also the Westerly end of Beman Avenue, SE, 25 feet; thence Westerly and parallel with the Northerly line of said Sublot Nos. 37 and 38, which is also the center line of Beman Avenue, SE, as vacated by said city ordinance, about 55 feet to the Southeasterly line of the New York Central Railroad Company's right of way; thence Southwesterly along the Southeasterly line of said right of way to its point of intersection with the Northerly prolongation of the Westerly line of said Sublot No. 38; thence Southerly along said Northerly prolongation and along the Westerly line of said Sublot No. 38, about 140.46 feet to the Southwesterly corner thereof; thence Easterly along the Southerly line of said Sublot Nos. 38 and 37, 80 feet on the Southeasterly corner of said Sublot No. 37; thence Northerly along the Easterly line of said Sublot No. 37, 140 feet to the place of beginning, be the same more or less, but subject to all legal highways.
Plaintiff prays that the defendants named above be required to answer and set up their interest in said premises or be forever barred from asserting the same; that all taxes, assessments, penalties and interest due and unpaid, together with the costs of certificate of title, be found to be a good and valid first lien on said premises, that the equity of redemption of said premises be foreclosed, said premises sold as provided by law, and for such other relief as is just and equitable.
The defendants named above are required to answer on or before the 6th day of November, 2019.
