    952118—Treasurer of Cuyahoga County, Ohio vs. David M. Malone, et al.

    David M. Malone, whose last known place of residence is 3923 Bluestone Road, Cleveland, OH 44121, otherwise whose place of residence is unknown; and Victoria M. Gibson-Malone, whose last known place of residence is 3923 Bluestone Road, Cleveland, OH 44121, otherwise whose place of residence is unknown, will take notice that on August 25, 2021, the undersigned, Treasurer of Cuyahoga County, Ohio, filed his complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that by reason of default of the defendants in the payment of taxes, assessments, penalties and the interest upon real estate as delinquent the sum of $9,181.53 for Parcel No. 682-22-074 and $2,263.91 for Parcel No. 682-22-015 is due and unpaid and a first and prior lien against the following described real estate to wit:

    Permanent Parcel No. 682-22-015; 682-22-074

    Parcel No. 1:

    Situated in the City of Cleveland Heights, County of Cuyahoga and State of Ohio: And known as being part of Original Euclid Township Lot No. 21, Tract No. 7 and forming a parcel of land bounded and described as follows: Beginning in the Northwesterly line of Bluestone Road, 60 feet wide, at the most Easterly corner of a parcel of land conveyed to Jerome J. Micco and Marguerite E. Micco, by deed dated October 10, 1951 and recorded in Volume 7409, Page 393 and by deed dated March 30, 1956 and recorded in Volume 8613, Page 633 of Cuyahoga County Records; thence Southwesterly, along said Northwesterly line of Bluestone Road, 48.56 feet to a point distant Northeasterly (measured along said Northwesterly line of Bluestone Road), 24.44 feet from the most Southerly corner of said land conveyed to Jerome J. Micco and Marguerite E. Micco; thence Northwesterly along a line making an included angle with the last described course of 90 degrees 25' 49" and passing through party walls, partitions, and beams of a two story frame dwelling, to a point in the Northwesterly line of said land conveyed to Jerome J. Micco and Marguerite E. Micco, said point being distant Northeasterly (measured along said Northwesterly line of said land conveyed to Jerome J. Micco and Marguerite E. Micco), 23.72 feet from the most Westerly corner thereof; thence Northeasterly along said Northwesterly line of land conveyed to Jerome J. Micco and Marguerite E. Micco, 49.28 feet to the most Northerly corner thereof; thence Southeasterly along the Northeasterly line of said land conveyed to Jerome J. Micco and Marguerite E. Micco, about 96.17 feet to said Northwesterly line of Bluestone Road, and the place of beginning, be the same more or less, but subject to all legal highways.

    Parcel No. 2:

    Situated in the City of Cleveland Heights, County of Cuyahoga and State of Ohio: And known as being part of Original Euclid Township Lot No. 21, Tract No. 7 and forming a parcel of land bounded and described as follows: Beginning in the Northwesterly line of Bluestone Road, 60 feet wide, at the most Southerly corner of a parcel of land conveyed to Jerome J. Micco and Marguerite E. Micco, by deed dated October 10, 1951 and recorded in Volume 7409, Page 393 and by deed dated March 30, 1956 and recorded in Volume 8613, Page 633 of Cuyahoga County Records; thence Northeasterly along said Northwesterly line of Blueston Road, 24.44 feet; thence Northwesterly, along a line making an included angle with the last described course of 89 degrees 34' 11", and passing through party walls, partitions and beams of a two story frame dwelling to the Northwesterly line of said land conveyed to Jerome J. Micco and Marguerite E. Micco; thence Southwesterly, along said Northeasterly line of land conveyed to Jerome J. Micco and Marguerite E. Micco, 23.72 feet to the most Westerly corner thereof; thence Southeasterly along the Southwesterly line of said land conveyed to Jerome J. Micco and Marguerite E. Micco, about 96.19 feet to said Northwesterly line of Bluestone Road, and the place of beginning, according to a survey dated February 29, 1961, by National Survey Service, Inc., Civil Engineers and Surveyors, be the same more or less, but subject to all legal highways.

    Plaintiff prays that the defendants named above be required to answer and set up their interest in said premises or be forever barred from asserting the same; that all taxes, assessments, penalties and interest due and unpaid, together with the costs of certificate of title, be found to be a good and valid first lien on said premises, that the equity of redemption of said premises be foreclosed, said premises sold as provided by law, and for such other relief as is just and equitable.

    The defendants named above are required to answer on or before the 6th day of December, 2021.
