Legal Notice2024 ADV 287761—Rachel E. Lyons, Administrator of the Estate of Maxamillian Graewe vs. Patricia Ann Nichols, et al.Unknown Executors, Administrators, Guardians, Custodians, or Assigns, or Heirs at Law, Next of Kin, Devisees, and Legatees of Melvin Graewe, deceased, the last known address of each being unknown, will take notice that on March 26, 2024, the undersigned, Rachel E. Lyons, Administrator of the Estate of Maxamillian Graewe, filed a complaint in the Probate Court, 1 Lakeside Avenue, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that she is the duly appointed, qualified, and acting Administrator of the Decedent's estate, and letters of authority were issued to her on March 20, 2024, by this Court in Case No. 2024EST285894; that Defendant, Patricia Ann Nichols ("Defendant Nichols"), is the Decedent's natural mother and thereby, is a next-of-kin and heir at law; that Defendant, Jeffrey A. Dolsey ("Defendant Dolsey"), while married to Defendant Nichols and residing in the State of Wisconsin, legally adopted the Decedent while Decedent was a minor; however, upon Defendant Nichols and Defendant Dolsey's subsequent divorce, Defendant Dolsey voluntarily terminated his parental rights; and that using Plaintiff's best efforts and due diligence, the Plaintiff is unable to determine whether Defendant Dolsey, or in the alternative solely Defendant Nichols, are heirs at law and next of kin of the Decedent, under Ohio's statute of descent and distribution according to the provisions of O.R.C. 2105.06. However, absent evidence or legal authority to the contrary, Plaintiff requests that the Court recognize the effect of the Wisconsin Court order terminating parental rights and hold that Defendant Dolsey's voluntary termination of parental rights on July 11, 1989, also terminated his right to inherit from the Decedent's intestate Estate.
Plaintiff respectfully requests this Court to determine who is or are the lawful next of kin, heirs at law, their administrators, guardians, custodians, or assigns and thereby is or are entitled by the laws of the State of Ohio, to inherit from the intestate Estate of Maxamillian Graewe, and for such other relief and the Court may determine is appropriate.
The defendants named above are required to answer on or before the 13th day of June, 2024.
