PUBLIC RECORD

The information listed on this website and in the printed version of our publication is the result of the publication of legal information in the public record. Unless the information is factually incorrect we are unable to remove your information from the listing without an order from the agency with whom the public record was created. While this may disturb some readers that information is now readily available, it is important to keep in mind that this information is available as a matter of the laws of the state of Ohio and the federal government. Please note that all legal advertising is purged from our online database 180 days after the last run date of the advertisement, and all new case filings are removed 180 days after the filing date.

If an order is sent to us from the public agency requesting the removal of information on the website pertaining to a person’s personal record, we will promptly comply with the request. We invite you to contact the organization where your action occurred that resulted in this listing. You may also with to contact the attorney who represented you in the legal action that resulted in the making of the public record. Your attorney will likely be able to advise you as to how you may have your records removed from the public record.

LAST KNOWN ADDRESS

The Ohio Civil Rules Procedure, Rule 4.4 Process: Service by publication, Section (A) states in part that the notice by publication shall contain the last known address, if any, of the person or persons whose residence is unknown. In order that we may identify the last known address to use in the public notice, we are suggesting that attorneys include the last known address in their Affidavit for Service by Publication. (See Pistner v. Baxter, 2 Ohio App.3d. 69.)

CUYAHOGA COUNTY COURT OF COMMON PLEAS

In the Court of Common Pleas, file or e-file the original Affidavit for Service by Publication and a copy of the Affidavit, with a time-stamped copy of the complaint attached. The Clerk of Court will forward the documentation to Daily Legal News. This request applies whether you file the Affidavit at the time you file the complaint with the Court, or if you file the Affidavit at a later date.

Common Pleas Court requires a deposit set by Local Rules as follows:

•  Divorce Actions $200.00

•  Civil Actions $150.00

•  Foreclosure Action $250.00

Foreclosure and Divorce actions: As a service, we will prepare the notice. We will send you an invoice and copy of the notice via email. Please note that the deposit is just that — a deposit. We will invoice you for any cost not covered by the deposit. If you do not receive an invoice and copy of notice within five (5) business days of filing, please contact our office. At the conclusion of insertions, and if the invoice has been paid, we will file the Publisher’s Affidavit of Publication with the Clerk of Court.

Civil actions: As a service, we will prepare the notice. We will send you an invoice and copy of the notice via email. If you do not receive an invoice and copy of notice within five (5) business days of filing, please contact our office. We will commence publication once payment is received. At the conclusion of insertions, we will file the Publisher’s Affidavit of Publication with the Clerk of Court.

CUYAHOGA COUNTY PROBATE COURT

For adversarial (ADV) cases in the Probate Court, file the original Affidavit for Service by Publication with a copy of the Affidavit, and a copy of the complaint attached. This request applies whether you file the Affidavit at the time you file the complaint with the Court, or if you file the Affidavit at a later date. The Probate Court will forward the documentation to Daily Legal News.

As a service, we will prepare the notice. We will send you an invoice and copy of the notice. We will commence publication upon receipt of payment in full. At the conclusion of insertions, we will file the Publisher’s Affidavit of Publication with the Court.

CLEVELAND MUNICIPAL COURT

In the Cleveland Municipal Court, in addition to filing with the Clerk the Affidavit for Service by Publication, please supply the Daily Legal News representative on site with copies of the Affidavit and complaint along with a deposit of $100.00 (check, payable to Daily Legal News). This request applies whether you file the Affidavit at the time you file the complaint with the Court, or if you file the Affidavit at a later date. Your doing so will expedite the handling of the Legal News notice, and will help us to avoid inadvertently missing the Notice.

As a service, we will prepare the notice. We will send you an invoice and copy of the notice. We will commence publication upon receipt of payment in full. At the conclusion of insertions, we will file the Publisher’s Affidavit of Publication with the Court.

SUBURBAN MUNICIPAL COURTS

Daily Legal News requires that the publication fees be paid in advance on all Suburban Municipal Court cases. Upon receipt of the Affidavit and copy of the complaint, we will send you an invoice for the cost of publication. We will commence publication upon receipt of payment in full. At the conclusion of insertions, we will send you the Publisher’s Affidavit of Publication to file with the Court.

Causes of action in the Suburban Municipal Courts should be verified by the attorney requesting publication that it meets all requirements of Local Court Rules.
