Banchek, Administrator of the Estate of David Mack, filed his amended complaint in the Probate Court, 1 Lakeside Avenue, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that he is the duly appointed and qualified Administrator of the Estate of David Mack, having been appointed as said Administrator on January 11, 2024, in Case number 2023 EST 284601; that said Decedent died seized of the entire interest in the following real estate located at 2175 East 83rd Street, Cleveland, Ohio 44103, County of Cuyahoga, State of Ohio, and further described as follows:

Situated in the City of Cleveland, County of Cuyahoga and State of Ohio (Zip Code 44103): and known as being sublot no. 4 and the Northerly 2 feet of sublot no. 5 in Stewart and Richardson's Re-Subdivision of part of original one hundred acre lot no. 407 as shown by the recorded plat in Volume 12 of Maps, page 31 of Cuyahoga County Records and together forming parcel of land 44.04 feet front on the easterly side of East 83rd Street (Formerly Lincoln Avenue) 122.27 feet deep on the northerly line, about 122.12 feet deep on the southerly line and 36.01 feet wide in the rear, as appears by said plat.
The Plaintiff/Administrator further represents that said Decedent died seized of the entire interest in the following real estate located at 4300 East 126th Street, Cleveland, Ohio 44105, County of Cuyahoga, State of Ohio, and further described as follows:

Situated in the City of Cleveland, County of Cuyahoga and State of Ohio and known as being Sublot No. 25 in Kennedy and Cristy Subdivision of part of Original One Hundred Acre Lot No. 469, as shown by the recorded plat in Volume 44 of Maps, Page 27 of Cuyahoga County Records, and being 40 feet front on the Westerly side of East 126th Street (formerly Kennedy Street), and extending back between parallel lines 135 feet, as appears by said plat, be the same more or less, but subject to all legal highways.
The Plaintiff/Administrator represents that it is necessary to sell said real estate for the following reason: to pay the debts of the Estate.
The Plaintiff/Administrator prays that all the rights, interests, and liens of the Defendants be fully determined, adjusted, and protected and that he may be authorized, and ordered to sell the Decedent's interest in the real estate as directed by the Court.
The defendants named above are required to answer on or before the 1st day of August, 2024.
