Darla Staten vs. Unknown Trustee of the John Robert Staten Trust, et al.Unknown Trustee of the John Robert Staten Trust, Unknown Beneficiaries of the John Robert Staten Trust, Unknown heirs, devisees, legatees, executors and legal representatives of the Estate of Delmer Staten, and Unknown heirs, devisees, legatees, executors and legal representatives of the Estate of Lois M. Staten, the address of each being unknown, will take notice that on August 22, 2024, the undersigned, Darla J. Hixenbaugh, a.k.a. Darla Staten, filed a complaint in the Probate Court One Lakeside Avenue, N.W., of Cuyahoga County, Ohio, alleging that on or about September 4, 1998, Delmer Staten and Lois M. Staten conveyed real property located at 2908 Barber Avenue, Cleveland, OH 44113 to John Staten, Trustee; that on or about September 4, 1998, Delmer Staten and Lois M. Staten conveyed real property located at 2809 Queen Avenue, Cleveland, OH 44113 to John Staten, Trustee; that on or about September 22, 2000, Darla J. Hixenbaugh aka Darla Staten conveyed real property located at 2912 Barber Avenue, Cleveland OH 44113 to John Staten, Trustee; that on or about April 24, 2021, John Staten died. The trust declaration was not found amongst his effects; that no copies of the Trust Declaration currently exist; that the beneficiaries of the Trust are unascertainable and that a vacancy in Trusteeship has existed since April 24, 2021, upon the death of John Staten, Trustee.
Plaintiff, Darla J. Hixenbaugh, aka Darla Staten, respectfully requests this Court grant judgment by 1) appointing a successor trustee as appropriate, or 2) terminate the trust, and distribute the real property to the single living grantor and to the two deceased grantor's estates, to be distributed in accordance with their estate.
The defendants named above are required to answer on or before the 15th day of November, 2024.
