Legal Notice2025 ADV 295432—Kimberly J. Baranovich, Esq., et al. vs. SCI Port Newark, etc., et al.Unknown Institutions for Support of the Blind, Unknown Qualified Charitable Organizations, and Unknown Public Libraries, the address of each being unknown, will take notice that on February 6, 2025, the undersigned, Kimberly J. Baranovich, Esq., filed a complaint in the Probate Court, One Lakeside Avenue, N.W., of Cuyahoga County, Ohio, alleging that Margaret Warnock entered into a Declaration of Trust for The Margaret Warnock Foundation on the 25th day of May 1990 as the "Donor" and with Don P. Brown as the sole named "Trustee"; that Donor, Margaret Warnock, is deceased as of November 1997 and the Declaration of Trust and terms therein became irrevocable; that Trustee, Don P. Brown, passed away on October 2, 2023; and that Don P. Brown, Jr. and Polly Brown, children of the decedent, Don P. Brown, are willing and able to serve as Co-Trustees of the Trust for consideration by this Court wherein they will dutifully accept the position of Co-Trustees of the Trust and Foundation, diligently administer the funds, and fulfill their fiduciary responsibility as outlined in the Trust insuring distribution of the assets in accordance therein.
Applicant prays this Court for an Order appointing Don P. Brown, Jr. and Polly Brown Successor Co-Trustees of Declaration of Trust for The Margaret Warnock Foundation UTD May 25, 1990 to administer the funds in accordance with the Declaration of Trust and distribute to qualified charities in accordance with the terms of the Trust.
The defendants named above are required to answer on or before the 18th day of April, 2025.
