Legal Notice2024 ADV 292522—Robert Montorsi, et al. vs. Rita Montorsi, et al.Estate of Teresina R. Montorsi and John Doe I, the address of each being unknown, will take notice that on January 9, 2025, the undersigned, Defendant Rita Montorsi ("Defendant"), filed an Answer, Affirmative Defenses, Counterclaim, Crossclaim, and Third-Party Complaint in the Probate Court One Lakeside Avenue, N.W., of Cuyahoga County, Ohio. The summary of the pleading is as follows: Plaintiff Robert Montorsi ("Robert") and Defendant are the children of Renato Montorsi ("Renato") and Teresina Montorsi ("Teresina"); that Robert is married to Plaintiff Patty Montorsi; that Defendant Ariana Zuk ("Defendant Ariana") is the daughter of Rita and the granddaughter of Renato and Teresina; and that Third-Party Defendants are the Estate of Teresina, which to Defendant's knowledge has not yet been created and John Doe I, which may be the executor or administrator of Teresina's Estate. The pleading arises out of the Trust Agreement created by Renato, a Private Settlement Agreement, Teresina's Will, changes to account beneficiary designations and a NonJudicial Agreement ("NJA"). Defendant's demand for relief on her declaratory judgment and accounting causes of action is as follows: (1) whether the agreement, the NJA or otherwise, is valid and enforceable and whether the Renato Trust was validly terminated; (2) in the event the agreement, whether the NJA or otherwise, is deemed invalid, a declaratory judgment as to the status of payments made to all parties and a declaratory judgment as to the status of the Renato Trust; (3) a declaratory judgment that all beneficiary designations on Teresina's assets that benefit Plaintiffs and/or Defendant Ariana are deemed invalid; (4) an order that Plaintiffs and Defendant Ariana shall account for all assets of Teresina and the Renato Trust; and (5) for any further relief that may be deemed proper.
The parties named above are required to answer on or before the 25th day of April, 2025.
