Legal Notice2025 ADV 298354—Alexandra Cunningham Cameron vs. Heather Milligan-Cangelosi, Executor of the Estate of Elaine Galgany, et al.Unknown Heirs, Next of Kin, Devisees or Legatees, and Any Other Interested Parties, the address of each being unknown, will take notice that on May 23, 2025, the undersigned, Alexandra Cunningham Cameron, filed a complaint in the Probate Court One Lakeside Avenue, N.W., of Cuyahoga County, Ohio, alleging that Elaine Galgany (hereinafter "Decedent") was a resident of Cuyahoga County, Ohio at the time of her death, occurring on February 18, 2025; that Heather Milligan-Cangelosi (hereinafter "Heather") was a neighbor of the Decedent, unrelated by blood, who worked her way into a position of trust over Decedent and Decedent's sister, Betty Rose Galgany ("Betty Rose"), who died on January 25, 2025, to the point where Heather became a fiduciary over both Decedent and Betty Rose; that Heather was appointed Executor of the Estate of the Decedent on April 21, 2025, in case # 2025 EST 296140; that Decedent and Betty Rose were never married, had no children, and had always lived with and provided support and assistance to each other; that on March 6, 2007, Decedent executed a last will and testament naming Plaintiff as the sole beneficiary of Decedent's estate in the event Betty Rose predeceased Decedent; that on the same date, Decedent's sister Betty Rose executed her will which also named Plaintiff as the alternate beneficiary should Decedent predecease her; that in 2022, Decedent disclosed to Plaintiff that she had been diagnosed with dementia. Decedent thereafter became more and more dependent on Betty Rose, whose own physical and mental health also continued to significantly decline; that at the point where the Decedent and Betty Rose became most susceptible and unable to manage their own affairs, a generic Will form was downloaded from WillForms.org and a document was produced for Decedent's signature on or about July 9, 2024 (the "2024 Will"); that upon information and belief, Heather downloaded the Will form and inserted her own name as beneficiary, which will form was purportedly executed by the Decedent on July 9, 2024; that the 2024 Will was executed at a time when Decedent had advanced stage dementia, lacked capacity, and was the subject of undue influence exerted by Heather. The 2024 Will names Heather as the sole beneficiary if Betty Rose predeceased Decedent; that on February 24, 2025, Heather disclosed that Decedent had died and further disclosed that she had been serving as Decedent's financial and healthcare power of attorney; and that shortly after disclosing that Decedent and Betty Rose had died, Heather indicated to Plaintiff's family that new wills had been executed and that she was the nominated executor.
Plaintiff further alleges that Decedent lacked mental capacity to execute the purported July 9, 2024, will of Decedent; and that the document dated July 9, 2024, is not the last will and testament of Decedent on the grounds of undue influence, lack of capacity, and for other reasons as may be demonstrated during the proceedings, including the trial of this matter.
Plaintiff prays that Decedent's Will dated July 9, 2024, be declared invalid and that the order admitting said Will to probate be set aside; further for attorney fees and other such relief as the Court may deem proper.
The defendants named above are required to answer on or before the 7th day of August, 2025.
