Unknown Transferees, Assigns, Executors, Administrators, Devisees and Heirs of Victoria L. Williams, Deceased, and all persons claiming by, through, or under them, the address of each being unknown, will take notice that on August 20, 2025, the undersigned, Pamela Boratyn, Director, Ohio Department of Transportation, filed a Petition to Appropriate Property and to Fix Compensation in the Probate Court, 1 Lakeside Avenue, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, which is an action to appropriate certain property for highway purposes, namely the making, constructing, repairing or improving of State Route 17, Section 13.50, Cuyahoga County, and to fix the value of said property.
The property sought to be appropriated is more specifically described as follows:

TEMPORARY EASEMENT FOR THE PURPOSE OF PERFORMING THE WORK NECESSARY TO
RECONSTRUCT DRIVE FOR 18 MONTHS FROM DATE OF ENTRY BY THE STATE OF OHIO, DEPARTMENT OF TRANSPORTATION

Situate in the State of Ohio, County of Cuyahoga, Village of Brooklyn Heights, and part of Original Independence Township Lot No. 3, Tract No. 1 west of Cuyahoga River, in Township 6, Range XII of the Connecticut Western Reserve and known as being part of the land deeded, now or previously, to Victoria L. Williams in AFN 202406120430 of the Cuyahoga County Fiscal Office and known as being part of permanent parcel number 531-24-008 lying on the right side of the centerline of East Schaaf Road and further described as follows:
Beginning in the existing southwesterly right of way line of East Schaaf Road at the easterly corner of the existing right of way of State Route 17 (Granger Road) conveyed as parcel 55 of the State of Ohio in deed volume 8251, page 362 of the Cuyahoga County Fiscal Office, being 25.00 feet right of station 117+36.44;
1. Thence along the existing southwesterly right of way line of East Schaaf Road (50.00 feet wide), South 56 degrees, 15 minutes, 50 seconds East, 42.61 feet to a northwesterly line of the existing right of way of East Schaaf Road (80.00 feet wide) 25.00 feet right of station 117+79.05;
2. Thence along the northwesterly existing right of way line of East Schaaf Road (80.00 feet wide) and continuing along the northwesterly line of the land deeded as parcel number 3 to Jessica Lynn Miller, Erika Marie Moran, and Judith M. Moran in AFN 202306120030 of the Cuyahoga County Fiscal Office, South 33 degrees, 44 minutes, 10 seconds West, 25.00 feet to a point 50.00 feet right of station 117+79.05;
3. Thence leaving the northwesterly line of Miller, Moran, and Moran's land, parallel with and 50.00 feet distant, by normal measurement, from the centerline of East Schaaf Road, North 56 degrees, 15 minutes, 50 seconds West, 64.70 feet to the existing southerly right of way line of State Route 17 (Granger Road) known as parcel 55, being 50.00 feet right of station 117+ 14.35;
4. Thence along the southerly existing right of way line of State Route 17, North 75 degrees, 11 minutes, 59 seconds East, 33.36 feet to the Place of Beginning and containing 0.0308 acres (1341.37 square feet) more or less, but subject to all legal highways and easements of record.
The basis for bearings used herein is grid north of the State Plane Coordinate System, Ohio North Zone (3401), NAD83(2011) (EPOCH 2010:0000) determined by GNSS measurements referenced to the Ohio Department of Transportation CORS.
Plaintiff prays the Court will:
A. Find that Plaintiff has complied with R.C. 163.01, et seq., and is entitled to appropriate the subject property.
B. Enter a judgment ordering the appropriation and possession of the real property or interest in real property and for the conveyance of the title to or easement interest in such property to the State of Ohio and/or to the entities other than the State of Ohio, if any, identified in Exhibit 1.
C. Upon the failure of the owner to file an answer, pursuant to R.C. 163.09, declare the value of the property or property interest appropriated herein and of damages, if any, to the residue, to be in the sum stated in Plaintiff's Findings, Declarations and Resolution to Appropriate attached hereto as Exhibit 1.
D. Cause a jury to be impaneled to make inquiry into and assess compensation to be paid and damages, if any, to the residue, for the appropriation of the within described property or property interests.
E. Grant Plaintiff all such other relief to which Plaintiff might be entitled.
The defendant named above is required to answer on or before the 5th day of December, 2025.
