Legal Notice2025 ADV 300333—Debra Sokolowski and Angela Studer vs. Irene V. Smith aka Irene Smith, Individually, as Executor of the Estate of Loretta Ventura, et al.Jane Doe 1, whose address is unknown, will take notice that on August 8, 2025, the undersigned, Debra Sokolowski and Angela Studer, filed a complaint in the Probate Court One Lakeside Avenue, N.W., of Cuyahoga County, Ohio, alleging that the Decedent, Loretta Ventura, died on or about February 4, 2025, in Cuyahoga County; that on February 1, 2025, while admitted at Hillcrest Hospital, Loretta executed a Last Will and Testament; that on February 1, 2025, Loretta had diminished capacity wherein she lacked sound mind to execute legal documents; and that the Will was not the free and voluntary act of Loretta, but was procured by the undue influence of Defendant Irene v. Smith aka Irene Smith.
Plaintiffs respectfully demand as follows:
I. An Order from the Court declaring that the Last Will and Testament purportedly signed by the Decedent, Loretta Ventura, on February 1, 2025 is invalid; and
II. An Order from the Court invalidating any and all inter vivos transfers of Loretta's assets; and
III. An Order from the Court entering judgment in favor of Plaintiffs and against Irene in excess of $25,000.00; and
IV. An Order imposing a constructive trust upon any assets now in Irene's possession and/or purchased with monies belonging to Loretta; and
V. An Order from the Court awarding reasonable attorney's fees, costs, prejudgment interest, post judgment interest, and punitive damages.
The defendants named above are required to answer on or before the 7th day of January, 2026.
