126123—U-Haul Co. of Massachusetts and Ohio, Inc., U-Haul Co. of Arizona and ARCOA Risk Retention Group, Inc. vs. Carlton Laney, et al.
Mya Goens, whose last known address is 1821 Wymore Ave., Cleveland, OH 44112, otherwise whose address is unknown, will take notice that on October 9, 2025, the undersigned, U-Haul Co. of Massachusetts and Ohio, Inc., U-Haul Co. of Arizona and ARCOA Risk Retention Group, Inc., filed a complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that this is an action seeking declaratory relief on behalf of Plaintiffs arising from violations by the named Defendants who knowingly, willfully, and intentionally conspired and agreed to a course of action to defraud Plaintiffs through an illegal scheme in which they leased a rental truck and intentionally crashed it into another vehicle in order to make unlawful and fraudulent insurance claims; that on February 6, 2025, at approximately 10:27 a.m., Laney leased the Rental Truck from the Rental Center for the purpose of staging a collision with Ray, Odom, and Goens, and for the purpose of presenting fraudulent claims for financial gain; that according to Laney, the alleged collision occurred at approximately 8:00 p.m. on February 7, 2025, while he was driving the Rental Truck on Belvoir St. after making a turn from Cliffview Blvd. in Cleveland, Ohio; that Laney said he lost control of the Rental Truck and struck the driver's side of another vehicle being driven by Ray and occupied by Odom and Goens as passengers; that Laney denied knowing the driver of the other vehicle involved in the subject collision, Ray, and also denied knowing his passengers, Odom and Goens; that upon information and belief, links were discovered: a. Laney and Ray are direct friends on Facebook; b. Laney is direct friends with several of Odom's relatives on Facebook; c. Odom is direct friends with several of Laney's relatives on Facebook; d. Laney and Odom follow each other on Instagram; and e. Odom follows several of Laney's relatives on Instagram; therefore, the Plaintiffs allege that the factual circumstances, written and oral statements of the Defendants, and documents provided, are evidence that the "loss" of February 7, 2025 was staged; and that all Defendant parties to this loss colluded with each other, to stage and execute an automobile collision for the purpose of claiming and collecting insurance or contractual benefits and therefore, engaged in fraudulent, intentional, or criminal acts.
Plaintiffs respectfully pray for the Court:
(a) To expeditiously make and enter a declaratory judgment that Laney, Ray, Odom, and Goens engaged in fraud by coordinating to stage an automobile collision with the Rental Truck;
(b) To declare and adjudge that the Renal Contract and associated liability coverages are cancelled, null and void ab initio and are rescinded;
(c) To declare and adjudge that the Defendants, nor any other party to this loss, are not entitled to any benefits or coverage affording liability arising or relating to the collision which is the subject of this Action;
(d) To declare and adjudge that the Plaintiffs have no duty to indemnify or defend Laney for any claims or lawsuits for injuries or damages by the Defendants;
(e) To declare and adjudge that Laney materially breached the contract with the Plaintiffs, and that due to the material breach by Laney, the Plaintiffs' contractual obligations are void;
(f) To enter a Judgment in favor of the Plaintiffs and against the Defendants herein;
(g) To award Plaintiffs their expenses of litigation, including costs and reasonable attorneys' fees; and
(h) To grant such other and further relief to Plaintiffs as the Court considers just and appropriate under the circumstances.
The defendant named above is required to answer on or before the 30th day of March, 2026.
