Sierra Avenue, Solana Beach, CA 92075, otherwise whose address is unknown, will take notice that on April 20, 2026, the undersigned, Bank of America N.A., filed a complaint in the Court of Common Pleas, 1200 Ontario Street, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, alleging that on or about September 1, 2005, Pierre Chbeir and Maguy Aljamous, husband and wife,granted to Aames Funding Corporation dba Aames Home Loan by merger Accredited Home Lenders, Inc., a security interest via a mortgage in the original principal amount of $196,000.00 (hereinafter "Mortgage") on the Property located at 28141 Edgepark Boulevard, Westlake, OH 44145, more properly described as follows:
Permanent Parcel No. 216-21-069
Situated in the City of Westlake, County of Cuyahoga and State of Ohio: And known as being Sublot No. 10 in Sandy Ridge Subdivision No. 7 of part of Original Dover Township Lot No. 14 as shown by the recorded plat in Volume 218 of Maps, Page 14 of Cuyahoga County Records and being 80 feet front on the Southerly side of Edgepark Boulevard and extending back of equal width 190 feet as appears by said plat.
Plaitiff further says that said Mortgage was recorded with the Cuyahoga County Recorder's Office as Instrument No. 200509090916 on September 9, 2005; that no assignment of Mortgage from Aames Funding Corporation dba Aames Home Loan by merger Accredited Home Lenders, Inc. to Bank of America N.A. was ever recorded with the Cuyahoga County Recorder, and the original has been lost, misplaced or destroyed and its whereabouts are unknown to Plaintiff; and that Plaintiff is the current servicer of the Mortgage and acknowledges that the Note remains active with sums still due and owing.
Plaintiff, Bank of America N.A., on behalf of the Mortgagors, Pierre Chbeir and Maguy Aljamous, prays for an order, judgment and decree declaring as follows:
A. The assignment of the original Mortgage from Aames Funding Corporation dba Aames Home Loan by merger Accredited Home Lenders, Inc. to Bank of America, N.A. as valid, enforceable and properly assigned to Bank of America N.A.;
B. An order requiring the Fiscal Officer of Cuyahoga County to record said Judgment Entry in the public records as assignment of the mortgage filed as Instrument No. 200509090916 on September 9, 2005; and
C. For such other and further relief the Court may deem just and equitable.
The defendant named above is required to answer on or before the 21st day of August, 2026.
