Swett vs. Franklin Malemud, Temporary/Interim Trustee, The Swett Family Trust, et al.Unknown Heirs at Law, Next of Kin, Devisees and Legatees of John Allen Swett, Deceased, Their Executors, Administrators, Guardians, Custodians or Assigns, the address of each being unknown, will take notice that on May 10, 2024, the undersigned, Dominic J. Vannucci, Administrator, Estate of John A. Swett, filed a First Amended Complaint for Trust Construction in the Probate Court One Lakeside Avenue, N.W., of Cuyahoga County, Ohio, alleging that John Allen Swett died testate, a resident of Cuyahoga County, Ohio, and was pronounced dead on February 3, 2024; that Plaintiff is the duly appointed, qualified and acting Administrator of the Estate With Will Annexed of the Estate of John Allen Swett, deceased, and letters of authority were issued to him on March 12, 2024, and recorded in Case No. 2024 EST 287332 of the records of that Court; that the named beneficiary of the Estate of John Allen Swett as provided in his Last Will and Testament is The Swett Family Trust which was created on October 8, 1996; that The Swett Family Trust is ambiguous as to the identity of the Trustee and the determination of the Successor Trustees; and that Plaintiff is administering the estate and needs guidance from this Court as to The Swett Family Trust and the beneficiaries of The Swett Family Trust.
Plaintiff demands the direction and judgment of this Court on the provisions and administration of The Swett Family Trust upon which the claims have arisen so that Plaintiff and the appointed Successor Trustee may be able to properly administer the trust estate, distribute to the proper beneficiaries and for such other relief as may be proper.
The defendants named above are required to answer on or before the 19th day of July, 2024.
