Legal Notice2025 ADV 300076—Melvin H. Banchek vs. Ronald S. Schickler, Successor Trustee of The Donna G. Moss Trust, et al.Phillip Lawrence Moss, III, Mary Katherine Guilbert, Patricia Moss, Julie Englander, and Lucille Smith, the place of residence of each being unknown, will take notice that on July 30, 2025, the undersigned, Melvin H. Banchek, filed a complaint in the Probate Court, One Lakeside Avenue, N.W., of Cuyahoga County, Ohio, alleging that the Donna G. Moss Trust was established on August 12, 2011; that Donna G. Moss is an incompetent adult, which is set forth in the Expert Evaluation, which has been filed with the Cuyahoga County Probate Court, Case number: 2025 GRD 298279, the Guardianship of Donna G. Moss; that there has not been a determination whether Donna G. Moss is incompetent by reason of mental disability in order to require a Guardianship for both her person, and Estate; that no one has been named as Successor Trustee of the Donna G. Moss Trust; and that it is necessary for a Successor Trustee to be appointed for the Donna G. Moss Trust in order to carry out the duties of the Donna G. Moss Trust.
The Plaintiff Melvin H. Banchek requests the Cuyahoga County Probate Court to grant his Complaint for Declaratory Judgment, and to appoint a Successor Trustee to the Donna G. Moss Trust, and any other legal or equitable relief the Court deems necessary.
The defendant named above is required to answer on or before the 24th day of October, 2025.
