Legal Notice2023 ADV 285522—Felicia T. Drake, Guardian of Brunetta T. Collins vs. David Paul Collins.David Paul Collins, whose last known place of residence is 16209 Telfair Road, Cleveland, OH 44128, otherwise whose place of residence is unknown, will take notice on March 5, 2024, the undersigned, Felicia T. Drake, Guardian of Brunetta T. Collins, filed an amended complaint in the Probate Court, One Lakeside Avenue, N.W., of Cuyahoga County, Ohio, alleging that she is the duly appointed guardian of the person and estate of Brunetta Tina Collins, have been appointed on April 21, 2021 in Cuyahoga County Probate Court Case No. 2020 GRD 256647.
Plaintiff further states for its first four causes of action that on four separate occasions between August 11, 2021 and September 20, 2021, Defendant withdrew funds belonging to the ward; that Defendant with either direct or indirect knowledge had full reason to know that this account was under control of Plaintiff; that Defendant used these funds for his own use and not for the benefit of the ward; and that by such action, Defendant has either misappropriated, concealed, converted and/or embezzled these funds all to the detriment to this guardianship.
Plaintiff further states for its fifth cause of action that Defendant did on May 6, 2022, cause the title to the ward's 2009 Chevrolet to be transferred to him; that Defendant having obtained the title to the 2009 Chevrolet, then disposed of said automobile by sale and/or transfer on May 22, 2022 to Changing Lanes Auto Sales; and that by reason thereof, the guardianship has been deprived of said vehicle and as such the Defendant has misappropriated, concealed. conversed and/or embezzled the guardianship of the inventory value of the vehicle.
Plaintiff demands judgment against Defendant on the First, Second, Third and Fourth Causes of Action in the total amount of $1,100 00 together with interest thereon as the Court may determine in this matter.
Further Plaintiff demands Judgment against Defendant on the Fifth Cause of Action in the amount of $9,000.00 together with interest thereon as the Court may determine in this matter.
Plaintiff further states that all of the actions taken by the Defendant were done with full knowledge of the guardianship and were done in order to convert, conceal, and/or embezzle the guardianship for which punitive damages should be awarded in the sum of $3,000.00.
Plaintiff further demands that the guardianship be awarded attorney fees and Court cost as determined by the Court.
Plaintiff further demands, that if any or all of said award are not delivered to the guardianship, then such remaining amount be a claim against any inheritance Defendant might be entitled to upon the death of his mother Brunetta Tina Collins.
The defendant named above is required to answer on or before the 27th day of May, 2025.
