2024 ADV 294086—County of Cuyahoga, Ohio vs. The Beneficiaries of the Estate of Tony Ipsaro.
The Unknown Beneficiaries of the Estate of Tony Ipsaro, the address of each being unknown, will take notice that on December 6, 2024, the undersigned, County of Cuyahoga, Ohio, filed its complaint in the Probate Court, 1 Lakeside Avenue, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, seeking to appropriate a portion of Permanent Parcel No. 562-03-004 for a period of 24 months from the date of entry by Cuyahoga County for public road purposes and for the purpose of performing grading for roadway widening and construction of a driveway.
WHEREFORE, the County of Cuyahoga, Ohio, prays: For the acquisition of the Real Property as set forth above; that upon the failure of the owner to file an answer pursuant to §163.09 of the Ohio Revised Code, this Court declare the value of $13,100.00 for the property taken, the improvement valuation in the sum of $100.00 and for the temporary construction easements to be in the sum of $2,100.00, for a total amount of $15,300.00 and for an order that any excess funds on deposit be returned to Petitioner; that this Court may cause a jury to be impaneled to make inquiry into and assess compensation to be paid by Petitioner for the above-described property rights required for the Rockside Road Bridges Nos. 03.23 & 03.32 Project, and more specifically for the replacement of the Rockside Road Bridges over the Cuyahoga River in the City of Independence, Ohio and the Village of Valley View, Ohio; that upon deposit of the fair market value, title to permanent fee interest, and one temporary easement, be awarded to the Petitioner, County of Cuyahoga County, according to law, and an order entered to such effect upon record; that this Court find that Petitioner, County of Cuyahoga, Ohio, has complied with all requirements of Chapter 6119.1 l(B)(l(c), 5555 and §§§ 163.04, 163.05, and 163.06 of the Ohio Revised Code, and is entitled to appropriate the subject for permanent parcels, and one temporary easement, and to exercise its right of quick take; that this Court cause any new parties to be added and direct such future notice to be given to a party in interest as the Court deems proper; and that this Court order the Clerk of Court to certify to the Cuyahoga Cunty Fiscal Officer all such portion of the final judgment that may be necessary to show the rights herein appropriated.
The defendants named above are required to answer on or before the 21st day of January, 2025.
