Legal Notice2025 ADV 296561—City of Solon, Ohio vs Forest Park Land Company, et al.Forest Park Land Company, whose address is unknown, will take notice that on March 19, 2025, the undersigned, City of Solon, Ohio, filed a Petition for the Appropriation of Property in the Probate Court, 1 Lakeside Avenue, Cleveland, Ohio 44113, of Cuyahoga County, Ohio, stating that the real property interest sought to be appropriated are as follows:

Situated in the City of Solon, County of Cuyahoga and State of Ohio, and known as being part of Original Solon Township Lot No. 26, Tract No. 1. Also being part of the land conveyed to Forest Park Land Company as recorded in Volume 9042, Page 518 of the Cuyahoga County Records, being more definitely described as follows;
Commencing at a 5/8" iron pin found in a monument box at the intersection of the centerline of Hunters Ridge Road (60 feet wide) and the centerline of Deer Run (60 feet wide);
Thence, along the centerline of Deer Run, North 51 deg. 38' 00" East, 661.77 feet to a 5/8" iron pin found;

Thence, leaving the southerly line of Original Lot No. 26, Tract 1, along the southeasterly line of Forest Park Subdivision No. 10, North 39 deg. 26' 38" East, 249.92 feet to a 1/2" iron pin found;
Thence, continuing along the southeasterly line of Forest Park Subdivision No. 10 and along the southeasterly line of Colonial Forest Estates, North 22 deg. 26' 31" East, 480.06 feet;
Thence, along the southeasterly line of Colonial Forest Estates the following four courses;
North 15 deg. 26' 19" East, 593.51 feet to a 1/2" iron pin found;
Thence, North 39 deg. 30' 37" East, 470.13 feet to a 1/2" iron pin found;
Thence, North 23 deg. 30' 37" East, 268.00 feet;
Thence, North 01 deg. 29' 23" East, 147.61 feet to the point of beginning.
Containing within said bounds 1.6220 acres of land as surveyed by KS Associates, Inc. under the supervision of Trevor A. Bixler, Professional Surveyor, No. 7730 in February and March, 2023.
Bearings are based on the Ohio State Plane, North Zone, NAD83(2011) Grid North.
Plaintiff further says that Defendant Forest Park Land Company is the owner of the property and/or has or may have an ownership interest in the property; and that based on the City's inability to find the title owner of the property, which entity is no longer in existence, and the inability to contact anyone associated with the title owner, the City was unable to follow the provisions of Sections 164.04 and 163.041 of the Ohio Revised Code to cause a written Notice of Intent to Acquire and Good Faith Offer to be served on Defendant Forest Park Land Company.
Plaintiff City of Solon prays that the Court:
a. Upon the failure of a title owner of the Property to make an appearance in this case after service by publication and Plaintiff City of Solon's filing of a motion to declare value and vest title to the Property in the City of Solon, grant said motion; or
b. In the unlikely event a title owner of the Property makes an appearance in this case after service by publication, cause a jury to be impaneled to assess the compensation to be paid to the owner of the interest in the Property appropriated, as provided in Chapter 163 of the Ohio Revised Code, and pursuant to the Charter of the City of Solon and the Constitution and laws of the State of Ohio, and upon payment to the owner, the Court shall order that the interest in the Property described herein may be vested in Plaintiff City of Solon, according to law.
The defendant named above is required to answer on or before the 25th day of June, 2025.
