Stefanik, et al.Unknown Executors, Administrators, Guardians, Custodians, or Assigns or Heirs-at-Law, Next of Kin, Devisees or Legatees of any Heirs-at-Law, Next of Kin, Devisees and Legatees of Margaret R. Stefanik, Deceased, the address of each being unknown, will take notice that on April 10, 2025, the undersigned, Robert M. Stefanik, Jr., filed a complaint in the Probate Court One Lakeside Avenue, N.W., of Cuyahoga County, Ohio, alleging that on or about October 4, 2024, Decedent died as a resident of the City of North Olmsted, County of Cuyahoga, Ohio; that Decedent left a document upon her death which purported to be her Last Will and Testament; that the document purporting to be the Last Will and Testament of Decedent was submitted for probate on or around February 6, 2025, and admitted on February 13, 2025, by the Probate Court of Cuyahoga County; and that the document admitted to probate as the Last Will and Testament of Decedent is not the Last Will and Testament of Decedent because Decedent executed the document purporting to be her Last Will and Testament while under severe pressure or influence of Colleen M. Beitel, and Decedent lacked testamentary capacity to execute such document.
Plaintiff demands and prays for judgment as follows:
A. That the Court issue declaratory judgments:
i. Declaring that the purported Last Will and Testament of Decedent is invalid, void and/or not effective; and
ii. Declaring that all of the assets of Decedent's estate must be distributed according to intestacy law under R.C. § 2105.06.
B. For compensatory damages against Defendant Colleen M. Beitel in an amount to be determined at trial;
C. For such other relief as this Court deems just and proper.
The defendants named above are required to answer on or before the 7th day of July, 2025.
